SPECIAL MEETING
Mayor Bourne called the February 4, 2020, Special Meeting of the City Council to order
`., at 3:01 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS PRESENT: Mayor Troy Bourne, Mayor Pro Tem John Taylor, and
Council Members Derek Reeve, Brian L. Maryott and Sergio Farias (arrived at 4:12 p.m.).
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS!CORRESPONDENCE/PUBLIC COMMENT ON CLOSED
SESSION ITEMS:
Rhen Cohen, City resident, submitted correspondence for Closed Session item A.
• Tom Hribar, City resident, spoke on Closed Session items A and B; and
Kerry Ferguson, City resident, spoke on Closed Session item A.
CLOSED SESSION (610.85)
A Closed Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) concerning the price and terms of payment concerning certain real
property located at 29943 Camino Capistrano (Northwest Open Space)
Negotiating parties: Red Tail Acquisitions; and, Capistrano Vineyards.
b. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and
Jeffrey Ballinger, City Attorney) concerning price and terms of payment concerning
property located at 28432 Calle Arroyo, San Juan Capistrano, CA 92675
(APN 664-071-01). Negotiating party: Paul Valenzuela.
c. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) concerning price and terms of payment concerning the City Hall
property located at 32400 Paseo Adelanto, San Juan Capistrano, CA 92675
(Portion of APN 668-101-23). Negotiating party: Jamboree Housing Corporation.
d. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) concerning price and terms of payment concerning City owned real
property located at APN 666-232-08, generally located at the most westerly end of
Cook Park/La Novia south of the intersection of Calle Arroyo and Rancho Viejo
Road. Negotiating party: OTRA, Inc.

e. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council
conferred with legal counsel pertaining to existing litigation in the matter of City of
Santa Ana v. County of Orange; City of Dana Point; City of San Clemente; City of
San Juan Capistrano; and DOES 1-10. U.S. Dist. Ct. Central Dist. of Cal.— So. Div.
Case No. 8:20-cv-00069.
f. Pursuant to Government Code Section 54956.8, the City Council conferred with
real property negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) pertaining to the price and terms of payment for license of real
property described as the Rancho Mission Viejo Riding Park at San Juan
Capistrano generally located at the southwest comer of Ortega Highway and La
Pata Avenue and addressed as 30753 La Pata Avenue. The property owner is the
City of San Juan Capistrano. Negotiating party: Action Sports Management Group.
g. Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council
conferred with Legal Counsel to discuss anticipated litigation — significant exposure
to litigation (4 items).
h. Pursuant to Government Code Section 54956.9(d) (4), the City Council conferred
with Legal Counsel to discuss initiation of litigation (1 item).
Pursuant to Government Code Section 54957.6, the City Council conferred with its
labor negotiators (City Council Sub -Committee comprised of Mayor Bourne and
Council Member Reeve) as to salary, compensation and terms of employment
of an unrepresented employee. The affected unrepresented employee is the
City Manager.
j. Pursuant to Government Code Section 54957.6, the City Council conferred with its
labor negotiators (City Council Sub -Committee comprised of Mayor Bourne and
Council Member Reeve) as to salary, compensation and terms of employment
of an unrepresented employee. The affected unrepresented employee is the
City Clerk.
ANNOUNCEMENT OF CLOSED SESSION ACTIONS: None.

_ There being no further business, Mayor Bourne adjourned the meeting to
