SAN JUAN CAPISTRANO CITY COUNCIL
SPECIAL MEETING
Mayor Maryott called the October 15, 2019, Special Meeting of the City Council to order
at 3:02 p.m., in the City Council Chamber.
ROLL CALL
COUNCIL MEMBERS PRESENT: Mayor Brian L. Maryott, Mayor Pro Tem Troy Bourne,
and Council Members Derek Reeve, John Taylor, and Sergio Farias (arrived at 4:25 p.m.).
COUNCIL MEMBERS ABSENT: None.
ORAL COMMUNICATIONS/CORRESPONDENCE/PUBLIC COMMENT ON CLOSED
SESSION ITEMS: None.
CLOSED SESSION (610.85)
A Closed Session was held for the following purposes, as authorized by statute:
a. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel City Manager; and Jeffrey Ballinger,
City Attorney) concerning the price and terms of payment concerning certain real
property located at: APN 121-141-25 and 121-141-26. Negotiating party: Frontier
Real Estate Investments, LLC.
b. Pursuant to Government Code Section 54956.8, the City Council met with its
Real Property Negotiators (Benjamin Siegel, City Manager; and Jeffrey Ballinger,
City Attorney) concerning the price and terms of payment concerning certain real
property located at APN 124-160-55 Commercial Property (31776 EI Camino Real)
and APN 124-160-57 Parking Lot (28874 Ortega Highway) Negotiating party:
Frontier Real Estate Investment, LLC.
c. Pursuant to Government Code Section 54956.9 (a), (d)(2), the City Council
conferred with Legal Counsel to discuss anticipated litigation — significant exposure
to litigation (4 items).
d. Pursuant to Government Code Section 54956.9 (a), (d)(1)&(2), the City Council
conferred with Legal Counsel to discuss four (4) cases of existing litigation — Danny
and Kayla Parker (Bumpin' Ballroom) v. City of San Juan Capistrano, Orange
County Superior Ct. Case No. 30-2018-00987411; Lifshultz v. City of San Juan
Capistrano, Orange County Superior Court Case No. 30-2017-00958536; Appeal
No. 30-2019-01043431; Bumpin' Ballroom v. City of San Juan Capistrano; Orange
County Superior Court Case No. 30-2018-01026419; and Schuyler Lifschultz v.
City of San Juan Capistrano, U.S. Dist. Ct. Case No. 8:19-cv-01497-JVS-ADS.
e. Pursuant to Government Code Section 54957.6, the City Council conferred with its
labor negotiators (City Council Sub -Committee comprised of Mayor Pro Tem
Bourne and Council Member Reeve) as to salary, compensation and terms of
.� employment of an unrepresented employee. The affected unrepresented employee
is the City Clerk.

f. Pursuant to Government Code Section 54956.9(a) & (d) (1), the City Council
conferred with legal counsel pertaining to existing litigation in the matter of Housing n
is a Human Right Orange County, at al. v. City of San Juan Capistrano, at al. U.S.
Dist. Ct. Central Dist. of Cal.— So. Div. Case No. 8:19-cv-00388.
ANNOUNCEMENT OF CLOSED SESSION ACTIONS: Jeffrey Ballinger, City Attorney
announced that Council Member Taylor recused himself from Closed Session Item A
due to his property proximity to the item.
ADJOURNMENT:
There being no further business, Mayor Maryott adjourned the meeting to the Regular
Meeting of Tuesday, October 15, 2019, at 5:00 p.m. for a public Business Session, in the
City Council Chamber.
