CHC Resolution-15-07-28-01CHC RESOLUTION NO. 15-07-28-01 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA APPROVING THE CULTURAL HERITAGE COMMISSION'S BYLAWS. Whereas, the Cultural Heritage Commission has conducted a thorough review of its bylaws and identified appropriate revisions to clarify the provisions and assure consistency with Commission practice and City Council policy; and, Whereas, the Environmental Administrator has determined that the project is exempt from review under the "general rule" that"CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activityis notsubject to CEQA" (Section 15061(b)(3) of the CEQA Guidelines), and will cause the Notice of Exemption to be posted pursuant to Section 15061(d) of the CEQA Guidelines which provides that "the notice shall not be filed with OPR or the county clerk until the project has been approved;" and, Whereas, the Cultural Heritage Commission has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA); and, Whereas, the Cultural Heritage Commission conducted duly -noticed public meetings on May 26, June 23, and July 28, 2015, pursuantto Title 9, Land Use Code, Section 9- 2.302, Public Meeting Procedures. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby approves the Cultural Heritage Commission Bylaws.
