A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN
.JUAN CAPISTRANO APPROVING THE HISTORIC DEPICTION PROGRAM FOR AC 06-
12 (PASEO DE VERDUGO)
Whereas, on April 15, 2008, the City approved an application for AC 06-12
for a commercial project incorporating a portion of the existing Mexico Lindo-Vaquero West
building located at 26755 Verdugo Street and further described as Assessor's Parcel No,
121-141-11; and
Whereas, City Council Policy No. 606 requires new development projects to
prepare and have approved a Historic Depiction Program (HDP) in order to protect and
preserve the City's unique cultural, historical, political, architectural and economic heritage;
and
Whereas, the applicant, Eric Altman, 26755 Verdugo LLC, 26755 Verdugo
Street, Ste. 200, San Juan Capistrano, CA 92675, prepared and submitted an HDP dated
October 29, 2009; and,
Whereas, the Cultural Heritage Commission conducted a meeting on
Tuesday, November 24, 2009, to review the Paseo de Verdugo HDP and consider public
input on the proposed Application.
NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage
Commission of the City of San Juan Capistrano does hereby make the following findings
with respect to the Paseo de Verdugo Historic Depiction Program:
The Cultural Heritage Commission hereby finds that the Historic Depiction Program
for the Paseo de Verdugo project is consistent with the intent of City Council Policy
#606, and meets the adopted HDP Review Criteria.
2, The Paseo de Verdugo HDP is consistent with the goals, policies and objectives of
the Sart Juan Capistrano General Plan's Cultural Resources Element because the
HDP presents elements of the under -represented history of the Basque culture in
San Juan Capistrano specifically related to the original owners of the existing
building on the site.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural
Heritage Commission of the City of San Juan Capistrano hereby approves the Paseo de
Verdugo HDP subject to the conditions in Exhibit A attached hereto and incorporated
herein.

These conditions of approval apply to the Historic Depiction Program (HDP) for AC 06-12.
Any proposed modifications to the HDP shall be submitted to the City Community
Development Department for review. For the purpose of these conditions, the term
"applicant" shall also mean the developer, the owner or any successor(s) in interest to the
terms of this approval.
1. The narrative text on the plaque shall be as amended by approval of the
CHC (see Exhibit B attached herein).
2. The plaque shall be mounted adjacent to an existing ground floor door of the
existing building being incorporated into the project, facing Verdugo Street.
3. The applicant shall comply with the requirements of Condition No. 40 of City
Council Resolution No. 08-04-15-03 to install the HDP per this approval prior
to the issuance of a Certificate of Occupancy.
4. The applicant or successors shall be responsible for perpetual maintenance
of the HDP in a pristine condition for the life of the development project.
