CHC Resolution-09-08-25-01RESOLUTION NO. 09-8-25-1 THE ECOLOGY CENTER HISTORIC DEPICTION PROGRAM SPR 08-01/CUP 08-03 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING THE HISTORIC DEPICTION PROGRAM FOR SPR 08.01/CUP 08-03 (THE ECOLOGY CENTER) Whereas, on August 12, 2008, the City approved an application for a site plan review and conditional use permit to allow the use of the historic Joel Congdon House as The Ecology Center, located at 32701 Alipaz Street and further described as a portion of Assessor's Parcel No. 121-190-57; and Whereas, City Council Policy No. 606 requires new development projects to prepare and have approved a Historic Depiction Program (HDP) in order to protect and preserve the City's unique cultural, historical, political, architectural and economic heritage; and Whereas, the applicant, Evan Marks, The Ecology Center, 32701 Alipaz Street, San Juan Capistrano, CA 92675, prepared and submitted an HDP dated August 20, 2009; and, Whereas, the Cultural Heritage Commission conducted a meeting on August 25, 2009, to review The Ecology Center HDP and consider public input on the proposed Application. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings with respect to The Ecology Center Historic Depiction Program: The Cultural Heritage Commission hereby finds that the Historic Depiction Program for The Ecology Center project is consistent with the intent of City Council Policy #606, and meets the adopted HDP Review Criteria, 2. The Ecology Center NDP is consistent with the goals, policies and objectives of the San Juan Capistrano General Plan's Cultural Resources Element because: a. The HDP the HDP provides accurate, appropriate and historical information that is accessible to the general public. b. The HDP will enhance the public's experience of a historic site listed in the National Register of Historic Places and the City's Inventory of Historic and Cultural Landmarks, and complies with the Secretary of the Interior's Standards for the Treatment of Historic Properties. Aside from required wording corrections, any proposed modifications to the NDP shall be submitted to the City Community Development Department for review. For the purpose of these conditions, the term "applicant" shall also mean the developer, the owner or successor(s) in interest to the terms of this approval. 1, The HDP shall be modified to change any bookcase -type shelves to free- standing units not to be mounted on the walls. 2. The applicant shall be responsible to carefully repair walls and hand -paint to match existing wallpaper at areas where holes have been made in the walls to the satisfaction of the Community Development Director. In the event the use is discontinued at the subject property, or said repairs are too extensive and/or are not satisfactory to the Community Development Director, the applicant shall propose a period appropriate reproduction type wallpaper pattern and obtain approval of the City, then purchase and hang said wallpaper. 3. Aside from the approval to cause holes to be drilled into the interior walls, subject to future repair, these conditions of approval are not intended to conflict with the terms of the License Agreement for the use of the Joel Congdon House to which the applicant is subject. 4. The following text corrections shall be made to the timeline narrative: a. For the 1860s text, insert the name and location of the referenced first brick residence built in Orange County. b. For the 1877 text, add that there was one stagecoach "line through" or "route through" San Juan Capistrano and add the name of the stagecoach line, which was "Seely & Wright." c. The first 1600s text should delete the reference to "a division of the Shoshone Indians," d. The second 1600s text should replace "Juaneno" with "Acjachemen" since the tribe was not called Juaneno until after the Mission was established. For 1794, the last .sentence should state that the Great Stone Church tools `°12" years to complete, not 9 years. f. For 1812, correct the text to reflect that the earthquake actually claimed 42, not 40, lives. 5. The applicant or successors shall be responsible for perpetual maintenance of the HDP in a pristine condition for the life of the development project.
