LONDRES USO June 10, 2003 PLANNING COMMISSION MINUTES ADJOURNED REGULAR MEETING Chair Cohen called the adjourned regular meeting of the San Juan Capistrano Planning Commission to order at 6:30 p.m. inside the Forster Mansion, 27182 Ortega Highway, San Juan Capistrano. Neely, Commissioner Robert Williams and Commissioner Bruce Tatarian, COMMISSIONERS ABSENT: Vice Chair Gene Ratcliffe and Commissioner Jim Mocalis. NONE E. CONDITIONAL USE PERMIT CUP 08-011 FORSTER MANSION EVENTS; a request to allow a wedding and special event venue to occur in the exterior grounds of the Frank Forster Mansion, with outdoor amplified live entertainment, dancing, catered food and alcohol, and off-site valet parking for up to 200 guests located on a 0.6 acre site at 27182 Ortega Highway, with a General Pian Land use designation of General Commercial, and a Zoning designation of Ortega Planned Community (CDP 78-01) Sector A-1. No permanent interior or exterior modifications or site improvement are proposed as a part of this project. (APN 666-241-09) (Applicant: Arpi Evans)(Project Manager: Teri Delcamp, Historic Preservation Manager). Staff: Presentation and Recommendation Historic Preservation Manager Teri Delcamp presented the staff report stating the public hearing for CUP 08-011 was continued from the May 12, 2009 Planning Commission meeting to allow the Commission an opportunity to hear an amplified sound system demonstration for the proposed events. The applicant is requesting approval to conduct a wedding and special event venue on the exterior grounds of the Frank Forster Mansion located at 27182 Ortega Highway, a 0.6 acre site with a General Plan Land Use designation of General Commercial and a Zoning designation of Ortega Planned Community (CDP 78-01) Section A-1. The applicant, Arpi Evans, proposes to use the exterior of the mansion for the events to include live entertainment, dancing, catered food and alcohol, and the interior for business offices and support uses for less than 50 persons. No physical changes are proposed. Parking would be provided at the Capistrano Collections commercial center adjacent to and east of the subject property. The Forster Mansion is designated on the City's Inventory of Historic and Cultural Landmarks (IHCL) and is listed in the National Register of Historic Places. The Conditional Use Permit (CUP) application is the result of a code enforcement case in response to the use being operated without a CUP or business license. Staff recommends that the Planning Commission observe the amplified sound system demonstration, provide comments, and continue the public hearing to the regular Planning Commission meeting on July 28, 2009, Public Comments None Planning Commissioner Comments and Questions The Planning Commission considered application issues to include: • Noise Impacts; • Stereo and speaker locations; • Ambient Noise Levels, • Hours of music; • Sound mitigation. After convening the meeting and receiving the staff report inside the Mansion, the Planning Commission, staff, the applicant, property owner and several residents went to the rear exterior patio area of the Forster Mansion where the amplified sound system, PC Minutes 2 June 10, 2009 dining, dancing and events are conducted. Arpi Evans distributed a "Sound System Evaluation" presentation by Joel Martin, sound consultant. Chair Cohen requested the speakers be set up exactly where they would be for events. The music was turned on and Historic Preservation Manager Teri Delcamp proceeded to take noise decibel readings at various locations in the patio and near the property line to the rear of the building close to the residence owned by Camren Grenier and near the Season's Senior Housing Project managed by Carol Ettlin, both of whom were present. Ms. Evans explained events procedures and operations and the Planning Commission walked the area asking questions. The Planning Commission, staff, applicant, and residents walked through the Season's Senior Housing project stopping behind the retaining wail adjacent to the Forster Mansion outdoor event area to listen to the music and take more decibel readings. The meeting next moved to Camren Grenier's residence behind the Forster Mansion which is approximately fifteen feet (15) from the property line adjacent to the Forster Mansion courtyard area where the weddings and special events are conducted. Again, the Planning Commission and other attendees listened to the music, asked questions, made comments, and staff took more decibel readings. Chair Cohen continued the public hearing to the regular Planning Commission meeting scheduled for July 28, 2009, G. NEW PUBLIC HEARINGS NONE H. CTD BUSINESS NONE I. NEW BUSINESS NONE J.
