PC Minutes-2017-02-28MINUTES February 28, 2017 PLANNING COMMISSION A. ORGANIZATION: 1. CALL TO ORDER: The Chair called the meeting to order at 6:30 p.m. 2. ROLL CALL: Commissioners Present: Mark Speros, Chair Lennie DeCaro Tim Neely Rob Williams Commissioners Absent: Ted Shown Staff Present: Joel Rojas, Development Services Director, Sergio Klotz, Assistant Development Services Director HongDao Nguyen, Deputy City Attorney 3. PLEDGE OF ALLEGIANCE: Chair Speros led the Pledge of Allegiance. B. ORAL COMMUNICATIONS: None. C. CONSENT CALENDAR: Items listed on the Consent Calendar are considered routine and will be enacted by one motion and one vote. There will be no separate discussion of these items. If discussion is desired, that item may be removed from the Consent Calendar and will be considered separately. Draft February 14, 2017 Planning Commission Minutes. Approved as presented by a 3-0-1 vote with Commissioner DeCaro abstaining. D. UNFINISHED BUSINESS: None. PC Action Minutes 2 February 28, 2017 E. NEW BUSINESS: None. F. PUBLIC HEARINGS: Consideration of Code Amendment (CA) 17-001, Amendment of the City's Current Regulations that Govern Accessory Dwelling Units ("secondary units"); an Ordinance amending Section 9-3.501 (Accessory Uses and Structures) of the San Juan Capistrano Municipal Code to comply with new state regulations that govern Accessory Dwelling Units (ADUs) (Project Manager: Joel Rojas, Development Services Director). Joel Rojas made the staff presentation and responded to questions. Chair Speros opened the Public Hearing and Barett Steele, a men-ber of the public provided comments. Chair Speros then, closed the Public Hearing. Adoption of Resolution PC RESOLUTION NO. 17-02-28-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO CALIFORNIA RECOMMENDING THAT THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO ADOPT LAND USE CODE AMENDMENT 17-001 AMENDING SECTION 9-3.501 AND APPENDIX A OF TITLE 9 OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE REGARDING ACCESSORY DWELLING UNITS. Commissioner Williams made a motion, seconded by Commissioner Neely, recommending that the City Council adopt an Ordinance to amend San Juan Capistrano Municipal Code Section 9-3.501 and Appendix A of Title 9 to make the City's current regulations that govern Accessory Dwelling Units consistent with new state regulations and recommending that the City Council direct staff to contact the California Department of Housing and Community Development on behalf of the City's homeowner associations to determine the level of restrictions on Accessory Dwelling Units allowed by homeowner associations. The motion passed by a 4-0 vote. AYES: Chair Speros and Commissioners DeCaro, Neely and Williams. NOES: None. ABSTAIN: None. Commissioner Speros made the motion, seconded by Commissioner Williams to select Commissioner Williams as the affirmative representative and Commissioner Speros as the Alternate affirmative representative to attend the City Council meeting to represent the view of the Commission and to answer PC Action Minutes 3 February 28, 2017 any question the City Council may have. AYES: Chair Speros and Commissioners DeCaro, Neely and Williams. NOES: None. ABSTAIN: None. G. INFORMATION ITEM: H. COMMISSION/STAFF DISCUSSION: Planning Commissioner Representatives reminder for upcoming City Council agenda items. The Commission was informed that Code Amendment Initiations items will be presented at the March 7, 2017, City Council meeting. 2. Planning Commission Update Report — Planning Commission Items to City Council. Report received and filed. I.
