Conditional Use Permit (CUP) 12-004, Trette Training Camp; a request for Consideration of Amending a Condition forApproved Conditional Use Permit (CUP 03-01) to Establish Definition and Approve of Outdoor Facility Use, Accessory to the Existing Lifestyle Training Center at 34000 Via De Agua, San Juan Capistrano (APN 675-034-05) (Applicant: David A. Kaech) (Project Manager: Laura Stokes, Project Manager). PC Meeting Minutes 3 May 8, 2012 Adoption of Resolution PC RESOLUTION NO. 12-05-08-02, CONDITIONAL USE PERMIT (CUP)12-004, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA DENYING MODIFICATIONS TO A PREVIOUSLY APPROVED CONDITIONAL USE PERMIT FOR "EDUCATIONAL USE" TO PERMIT OUTDOOR RECREATIONAL FACILITIES USE ON AN EXISTING 1.04 ACRE FIELD FACILITY LOCATED AT 34000 VIA DE AGUA (ASSESSORS PARCEL NUMBER: 675-034-05) (TRETTE TRAINING CAMP). Commissioner Cohen made a motion, seconded by Commissioner Parkhurst, to adopt a resolution denying the proposed project and requesting staff to provide the Planning Commission with a 90 -day compliance status review. The motion passed by a 5-0 vote. AYES: Chairman Rob Williams and Commissioners Sheldon Cohen, Tim Neely, Roy Nunn, and Jeff Parkhurst. NOES: None. ABSTAIN: None. 3. Continued Consideration of Code Amendment (CA) 11-02, Assembly Uses: a proposed Land Use Code Amendment to Title 9, Article 3 of the Land Use Code and Appendix "A," Definitions of the Municipal Code Regarding Assembly Uses (Project manager: Grant Taylor, Development Services Director). Adoption of Resolution PC RESOLUTION NO. 12-05-08-03, CODE AMENDMENT (CA) 11-02, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE APPROVING CODE AMENDMENT (CA) 12-01 AMENDING CERTAIN PROVISIONS OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE, TITLE 9, LAND USE CODE PERTAINING TO ASSEMBLY USES. Commissioner Neely made a motion, seconded by Commissioner Nunn, to adopt a resolution approving the proposed project subject to revisions to the draft definition of "church" to read as follows: "Church: A use provided by a legally constituted religious organization for public and family worship of a deity or deities, together with buildings and uses that are accessory thereto, and limited to the teaching of religious dogma, accessory social functions, and one single-family dwelling for use as a minister or caretaker residence. Appeal of the Development Services Director's Denial of the Replant Plan for Tree Removal Permit (TRP) 11-091, Alipaz Plaza: an appeal of the Director's denial of the replant plan for the replacement of thirteen (13) Eucalyptus trees at Alipaz Plaza located at 31952 Del Obispo Street, and generally located near the southwest corner of Del Obispo Street and Alipaz Street (Assessor's Parcel Number 668-151- 08) (Appellant: Jean Gross) (Proiect Manager: Joe Aguirre, Planning Intern) Adoption of motion Commissioner Cohen made a motion, seconded by Commissioner Parkhurst to deny the appeal and to refer the replant plan to the Design Review Committee (DRC) for review and final approval. I. STAFF & COMMISSION COMMENTS: Staff briefed the Planning Commission on several upcoming projects and on the status of previously approved projects. J.
