PC Resolution-05-06-14-01PC RESOLUTION NO. 05-06-14-1 CONDITIONAL USE PERMIT 05-03 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING A CONDITIONAL USE PERMIT FOR A CITYWIDE SIREN WARNING SYSTEM WITH NINE SIRENS, AND ESTABLISHING PROCEDURES FOR FUTURE SIRENS. WHEREAS, Southern California Edison (“Applicant”) proposes to replace 8 (eight) existing sirens and associated control cabinets at various locations throughout the City and install 1 (one) new wood pole with sirens within the Meredith Canyon area for the purpose of establishing an early warning system in the event of an emergency at the San Onofre Nuclear Generating Station. The existing sirens that are mounted on 50 foot tall poles will be replaced with new sirens that measure approximately between 6’-0” to 10’-0” in height and have a diameter of approximately 2’-6”. The weight of the sirens ranges from 460 pounds to 710 pounds; and, WHEREAS, a conditional use permit has been filed by the applicant to allow the installation of these sirens and establish locational criteria and design standards for future sirens; and, WHEREAS, the proposed project has been processed pursuant to Section 9-2.301, Development Review of the Land Use Code and reviewed for compliance with the City’s General Plan and the City’s adopted Architectural Design Guidelines; and, L-, WHEREAS, the Environmental Administrator has reviewed the project pursuant to Section 1531 1 of the California Environmental Quality Act (CEQA) and issued a Class 3 categorical exemption and caused a Notice of Exemption to be posted pursuant to Section 15062 of the CEQA Guidelines, and has otherwise complied with all applicable provisions of the California Environmental Quality Act (CEQA); and, WHEREAS, on May 19,2005, the Design Review Committee reviewed the project for compliance with the City’s design standards; and, WHEREAS, the Planning Commission conducted a duly noticed public meeting on June 14, 2005 pursuant to Section 9-2.313 of the Municipal Code to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings: 1. The proposed project is consistent with the policies and objectives of the San Juan Capistrano General Plan, specifically, the Goal 2 and 4 of the Safety Element: Safety Goal 2, Protect the community from hazards related to air pollution, nuclear powerproduction, hazardous materials, and ground transportation which states that PC Resolution 05-06-14-1 2 June 14,2005 the City “Coordinate with federal and state agencies and Southern California Edison to reduce the risks related to nuclear power production (Policy 2.2)” Safety Goal 4, Improve the ability of the City to respond effectively to natural and human-caused emergencies which states that the City “Support the development of local preparedness plans and multi-jurisdictional cooperation and communication for emergency situations.. . (Policy 4. I) “; and, 2. The proposed project complies with all applicable provisions of the Land Use Code subject to the mitigation measures and conditions of approval contained in this resolution. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby confirm issuance of a categorical exemption and approves the project subject to the following conditions of a p prova I: 1. Conditional Use Permit (CUP) 05-03 is granted to establish locational standards and design criteria for processing future siren installations and alterations, which may be approved administratively pursuant to the terms and conditions of this conditional use permit. This approval also allows modifications to eight (8) existing sirens and installation of one (1) new siren, and is granted based on the application materials prepared and submitted by Southern California Edison (SCE) on March 11,2005, including an SJC Siren Replacement project binder that contains existing and proposed siren locations, alterations and finish colors. The project binder and proposed alterations of the siren sites are approved as submitted and conditioned herein, and shall not be further altered unless reviewed and approved by the affected city departments. Minor modifications and additions to this approval which are determined by the Planning Director to be in substantial conformance with the approved site locations, and which do not intensify or change the use or require any deviations from adopted standards, may be approved by the Planning Director upon submittal of an application and the required fee. If not appealed, this ap roval shall become effective on the first business day following the fifteenth (15 ) day after the date of the Planning Commission’s approval. tR 2. Plans submitted for grading/ building permit plan check shall include as part of the black line information sheet, a complete copy of the signed Planning Commission Resolution. 3. The applicant shall secure all applicable building permits for construction of the proposed installations as required by the Building Official. 4. Pursuant to Section 8-1.03 of the Land Use Code all construction activities which includes the delivery and/or recovery of materials, supplies or construction equipment shall be conducted in accordance with the prescribed hours of operation. PC Resolution 05-06-14-2 3 June 14,2005 Monday through Friday Saturday 7:OO a.m. to 6.00 p.m. 8:30 a.m. to 4:30 p.m. Construction activity is prohibited on Sundays and on any federal holiday unless waived by the Building Official. 5. Approved colors for new siren installations are ANSI 70 (Gray) for the poles and GN-1 (Forest Green) for the cabinets as specified in the approval application materials (or equivalent colors as approved by the Planning Director). These colors may be modified to another earth-tone shade to better blend with the surrounding vegetation, as approved by the Planning Director. 6. Landscape screening shall be installed to screen siren poles and cabinets where visible to the general public and where appropriate, as approved by the Planning Department. EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become effective following expiration of the fifteen (1 5) day appeal period without filing of an appeal application. The appeal period shall expire at 500 PM, Wednesday, June 29, 2005. This project approval shall be valid for a period of 2 years from the date of approval of this resolution, and shall expire on June 29, 2007 unless a time extension request or building permit application related to this discretionary approval is submitted to the City .J prior to that date.
