PC Resolution-05-01-11-02PC RESOLUTION NO. 05-01 -1 1-2 TREE REMOVAL PERMIT (TRP) 04-171 -v’ AN ACTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO CONFIRMING ISSUANCE OF A CATEGORICAL EXEMPTION AND APPROVING ATREE REMOVAL PERMIT FOR TREES LOCATED WITHIN ORTEGA RANCH BUSINESS PARK. Whereas, the project applicant, Ortega Ranch, LLC is requesting approval to remove a approximately 137 trees of which fourteen have a diameter of approximately 24 inches or greater located on a site proposed to be developed as an office business park. The property is located on the west side of Rancho Viejo Road and north of Ortega Highway and is General Plan designated Office Research Park (ORP); and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development Review, and Section 9-2.349, Tree Removal Permit of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and issued a Class l(h) categorical exemption and caused a Notice of Exemption to be posted pursuant to Section 15062 of the CEQA Guidelines. Whereas, the Planning Commission conducted a duly noticed public meeting on January 1 I, 2005 pursuant to Section 9-2.313 of the Municipal Code to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby find that the proposed project complies with all applicable provisions of the Land Use Code, that several of the trees determined to be removed have been determined by an arborist to be dead or in poor health, or trees are within areas proposed for development construction, that the applicant has prepared a landscaping plan that proposes a number of replacement trees that significantly increases the number of trees within the area, and that the proposed tree removal shall be subject to the following conditions: I. The additional fifteen trees identified as dead or dying trees on the Tree Removal exhibit (Tree numbers 6, 10, 12,68,69,74,75,79,80,81,83, 84,85,86 and 87), shall be removed; and 2. The applicant shall retain in place or relocate existing trees on site to the extent permitted by the grading plan, and shall install replacement trees in accordance with the Final Landscaping Plan as approved by the Design Review Committee prior to issuance of a grading permit. PC Resolution 05-01-1 1-2 2 January 11,2005 NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby confirm issuance of a categorical exemption. Ld' EFFECTIVE DATE & EXPIRATION DATE: This project approval shall become effective following expiration of the fifteen (I 5) day appeal period without filing of an appeal application pursuant to Section 9-2.31 I of Title 9, Land Use Code. The fifteen (15) day appeal period shall expire at 500 p.m. Wednesday January 26,2005.
