PC Resolution-07-10-23-01PC RESOLUTION NO. 07-10-23-1 ARCHITECTURAL CONTROL (AC) 07-05, BOYS & GIRLS CLUB A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA CONDITIONALLY APPROVING THE PROPOSED "TEEN CLUB" ADDITION TO THE BOYS & GIRLS CLUB LOCATED AT 1 VIA POSITIVA AND MORE PRECISELY REFERRED TO AS ASSESSORS PARCEL NUMBER 121-190-56 (Boys & Girls Club Teen Club) Whereas, the Boys & Girls Club has requested approval of preliminary site, architectural, landscape, and related design plans for a proposed building addition to the San Juan Capistrano Community Center Building for the existing Boys & Girls Club; the proposed two-story, 6,580 square foot (sf) building addition would be situated along the south elevation of the existing gymnasium and would "house" the proposed teen center which would provide a separate facility to serve teens independent from the elementary and middle school children served by the Club; the proposed project would require the removal of six (6) existing trees from the south elevation of the existing gymnasium; and, Whereas, on May 1, 2007, the City Council allocated $8,000 of the $200,000 previously pledged by the City Council, to pay permit processing fees for the proposed project; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, General Review Procedures of Title 9, Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and has determined that the project is categorically exempt from further review pursuant to Section 15301(e) of the California Environmental Quality Act (CEQA) Guidelines which exempt building additions of less than 10,000 gross square feet (GSF) to an existing building where all public services and facilities are available to allow for maximum development permissible in the General Plan; and, the area in which the project is located is not environmentally sensitive; and will cause the Notice of Exemption to be posted pursuant to Section 15061(d) of the CEQA Guidelines which provides that Athe notice shall not be filed with OPR or the county clerk until the project has been approved;@ and, Whereas, the Design Review Committee reviewed the proposed project on August 16, September 6, and September 20 and at the September 20 meeting, recommended Planning Commission approval with conditions; and, Whereas, the Parks, Recreation, & Equestrian Commission conducted a duly -noticed public meeting on October 15, 2007 pursuant to the provisions of Title 9, Land Use Code, Section 9-2.339, Public Meeting Procedures, Administrative Policy 409, and Planning Department Policy 510 to consider public testimony on the proposed project and recommended conditional approval; and, PC Resolution No. 07-10-23-1 AC 07-05, Boys & Girls Club 2 October 23 2007 Whereas, the Planning Commission conducted a duly -noticed public meeting on October 23, 2007 pursuant to the provisions of Title 9, Land Use Code, Section 9-2.339, Public Meeting Procedures, Administrative Policy 409, and Planning Department Policy 510 to consider public testimony on the proposed project and has considered all relevant public comment. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings: (a) The project plans comply with all provisions of Title 9 of the San Juan Capistrano Municipal Code because Title 9 establishes the basis for the "SP" (Specific Plan/Precise Plan) and Specific Plan 85-01, Kinoshita Farm provides that the City will establish development standards as part of the development plan review process, and the project has been designed to be compatible with the community center complex; and, (b) The architectural and general design of the project is generally consistent with the -goals, policies and objectives of the Community Design Element and all other applicable provisions of the General Plan because the project has been designed consistent with the applicable provisions of the Architectural Design Guidelines; and, (c) The site plan is compatible with surrounding existing and proposed land uses because proposed conditions of approval will require that operational provisions be added to the Memorandum of Understanding to address the operational impacts of the project; and, (d) The general design considerations, including the character, scale and quality of the design are consistent with the adopted Architectural Design Guidelines because the proposed design incorporates building massing, roof plan, and color and materials that are compatible with the design of the existing community center complex; and, (e) The site plan is functional and safe in regards to existing or mitigated off-site conditions as they relate to adequacy of vehicular, bicycle and pedestrian circulation because the site plan accommodates pedestrian walkways, provides for bicycle storage, and the traffic report prepared by the City determined the project would have no significant impact on the service levels of the two main intersections, Del Obispo Street/Camino del Avion and Del Obispo Street/Alipaz street; and, (f) The general landscape design, including the location, type, size, color, texture and coverage of plant materials has been considered to insure visual relief to complement buildings and structure and the project will provide for re -landscaping the existing median at the southwest corner of the addition, and will prepare and implement a landscape plan for the existing community center courtyard. Boys & Girls Club 3 October 23 2007 NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby approves the project subject to those conditions of approval established by Exhibit A, attached hereto and incorporated herein. EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become effective following expiration of the fifteen (15) day appeal period without filing of an appeal application. The appeal period shall expire on Wednesday, November 7, at the close of business at City Hall. This project approval shall be valid for a period of two years from the date of approval of this resolution, and shall expire on October 23, 2009 unless a time extension request or building/grading permit application related to this discretionary approval has been submitted to the City prior to that date. All building and/or grading permit plans and physical development of the project site shall be in substantial conformance with the project plans as approved by the Planning Commission in conjunction with this discretionary application and consisting of plans prepared by HBA architects, entitled "Boys & Girls Club Teen Center", dated 06.20.07 and revised to 10.11.07. Minor modifications that are determined by the Planning Director to be in substantial compliance with the PC -approved and that do not intensify nor change the use nor require any deviations from City standards, may be approved by the Planning Director pursuant to. (PLN) 2. Approval of this application does not relieve the applicant from complying with other applicable federal, state, County of Orange or City regulations or requirements. (PLN) 3. The applicant, its agents, and assignees shall defend, indemnify, and hold harmless the City of San Juan Capistrano, its elected and appointed officials and employees, and its contract consultants, from any claim, action or proceeding to attack, set aside, or void or annul any land use approval associated with this project, including but not limited to environmental impact report requirements under Municipal Code Title 9 land use approvals. Upon notice provided by the City to the applicant, its agents, or assignees, of service of process of such claims or actions, the project proponent, it agents, and assignees, shall immediately act to provide an appropriate defense to such claims or actions. (PLN) 5. The applicant or his/her successors in ownership, shall be responsible for informing all subcontractors, consultants, engineers, other business entities providing services related to the project, or any subsequent owner should the project be sold, of their responsibilities to comply with these conditions and all pertinent requirements in the San Juan Capistrano Municipal Code, including, but not limited to, the requirements for all contractors to obtain a City business license, and for approval by the Planning Department of a Temporary Use Permit for construction trailers and staging areas. (PLN) 6. The applicant shall pay all fees at the time fees are determined payable, including any required supplemental plan check fees due to plan revisions, and comply with all requirements of the applicable federal, state, County of Orange, City and other local agencies. Should any discrepancy arise between these conditions and subsequent conditions established by final revised plans approved for any subsequent phase, those conditions established as part of the later approval shall prevail. 9. The applicant or his/her successors in ownership, shall be responsible for the on-going maintenance and upkeep of the developed and undeveloped portions of the site, in accordance with the City's Municipal Code. (PLN) Planning Conditions: 10. Prior to building permit issuance, staff will have secured City Council approval of a Memorandum of Understanding addendum to address the following operational issues of the proposed teen center expansion: Boys & Girls Club will designate a staff member to periodically walk the community center complex to address loitering and littering issues during club operation. The designated site monitor will be on -duty after school to assure that loitering is prevented. Children waiting to be picked up by parents or siblings could be required to wait inside the building. • Boys & Girls Club will designate parking areas for teens within the Sports Park parking area or the adjoining school site parking. Teens will not be permitted to park in the main community center parking lot and will be required to register their vehicles with the Club to allow parking in authorized on-site (Sports Park) and off-site (Marco Forster and Del Obispo Schools) parking areas. Boys & Girls Club will be financially responsible for maintaining any common facilities including bathrooms used by Boys & Girls Club staff, members, or guests; and will be responsible for the cost of any repairs that are attributable to Boys & Girls Club use of the community center complex. Boys & Girls Club will manage evening events (e.g. dances) as closed events with no entry to the event or leaving the event during the actual hours of the event. Arrival to and departure from the community center complex for teen center special events shall be restricted to specific times to prevent potential loitering which could lead to illicit activity. Boys & Girls Club may be required by the City to hire private security in order to conduct special events. Boys & Girls Club will train appropriate staff in the operational requirements of the Boys & Girls Club, the teen center, and special PC Resolution 07-10-23-1 Conditions of Approval AC 07-05, Boys & Girls Club Date of Approval: October 23, 2007 page 3 of total pages Effective Date: November 7, 2007 events and require staff to enforce approved operational policies and restrictions. 12. Prior to building permit issuance, the Boys & Girls Club will prepare and submit a landscape enhancement plan for the main community center courtyard which shall be subject to review and approval by the Design Review Committee. The plant palette will incorporate California native plant species. Prior to issuance of an occupancy permit, the project shall complete all improvements and landscaping to the courtyard consistent with the Design Review Committee -approved landscape enhancement plan.
