PC Resolution-07-04-24-01PC RESOLUTION NO. 07-04-24-01 ARCHITECTURAL CONTROL 02-07 Modification #2 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO DENYING A SIGN PROGRAM AND SCOREBOARDS FOR JSERRA HIGH SCHOOL, SOUTH CAMPUS (PUEBLO SERRA HOLDINGS, INC.) Whereas, Randall Boone Signs has requested approval of a Modification to Architectural Control (AC) 02-07 in order to construct signage and scoreboards on the JSerra High School South Campus, located on the northeast corner of Junipero Serra Road and Camino Capistrano, and which is General Plan designated Planned Community (PC) and classified as Public & Institutional (P&I) on the Official Zoning Map; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development Review of the Land Use Code; and, Whereas, the Planning Commission's action is not subject to the California Environmental Quality Act (CEQA) because projects that are rejected or disapproved are exempt from CEQA pursuant to Public Resources Code, §21080(b)(5)); and Whereas, the proposed project is not consistent with the approved plans for JSerra High School South Campus, AC 02-07 in that the original approval for AC 02-07 did not include wall signage, and only included conceptual location references to scoreboards located in the vicinity of the football field, baseball field and incorporated into the building design of the Sports Plaza Building; and, Whereas, Land Use Code Section 9-2.313(c) requires the Planning Commission to make six findings in order to approve an Architectural Control and Modification thereto, and the Planning Commission has determined that the following two findings cannot be made, as explained below: 1. The general design considerations, including the character, scale and quality of the design are consistent with the adopted Architectural Design Guidelines of the City Finding: The architectural and general design of the project is not consistent with the goals, policies and objectives of the Community Design Guidelines in that accessory structures, including the scoreboards, are required to be in scale and character with the design of the surrounding South Campus and the scoreboards as proposed are excessive in size and height and will be visually obtrusive both when viewed from on-site and off-site. For example, the proposed softball field scoreboard will extend three feet above the block wall along the southern boundary of the property and would be visually obtrusive from the adjacent Casitas Capistrano neighborhood. In 535195.1 PC Resolution 07-04-24-01 2 April 24, 2007 addition, as documented in the staff report for the project, the proposed number, size and height of the scoreboards are greater than scoreboards on other nearby school campuses. The proposed height of the football/track scoreboard is over thirty (30) feet; which is over ten feet taller than similar scoreboards at other school campuses; and, 2. The site plan is compatible with surrounding existing and proposed land uses Finding: The proposed project is not compatible with surrounding existing land uses in that certain scoreboards will be visible from the public right-of-ways and the adjacent residential neighborhoods, and the proposed softball scoreboard is of a height and size that could present adverse visual intrusion to the adjacent residential uses. Whereas, the Planning Commission conducted duly -noticed public meetings on March 27, 2007 and April 24, 2007 pursuant to the provisions of Title 9, Land Use Code, Section 9-2.339, Public Meeting Procedures, Administrative Policy 409, and Planning Department Policy 510 to consider public testimony on the proposed project and has considered all relevant public comment. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission finds the proposed sign program and scoreboards are not consistent with the land use designation, the approved plans for AC 02-07, and the requirements for findings as outlined in the Land Use Code. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby denies Architectural Control (AC) 02-07 Modification #2 based upon the findings set forth herein. EFFECTIVE DATE & FINAL APPROVAL: The decision of the Planning Commission shall become final and effective following expiration of the fifteen (15) day appeal period without filing of an appeal, and the appeal period shall expire at 5:00 p.m., Wednesday, May 9, 2007.
