PC Resolution-08-05-13-02PC RESOLUTION NO. 08-05-13-2 ARCHITECTURAL CONTROL (AC) 07-13 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO CONFIRMING ISSUANCE OF A CATEGORICAL EXEMPTION AND APPROVING A COVERED CARWASH FOR THE TOYOTA AUTO DEALERSHIP LOCATED AT 33395 CAMINO CAPISTRANO, GENERALLY LOCATED 960 FEET NORTH OF STONEHILL DRIVE (ASSESSORS PARCEL NUMBER 121-240-75) (TOYOTA OF SAN JUAN CAPISTRANP. WHEREAS, Mike Kahn is owner of real property described as Assessor's Parcel Number 121-240-75 located at 33395 Camino Capistrano, San Juan Capistrano; and, WHEREAS, Toyota of San Juan Capistrano, proposes to legalize and existing non- conforming covered carwash bay at the rear of the existing sales office building at the Toyota of San Juan Capistrano auto dealership. Said structure is constructed with a metal roof material and will not contain motorized drying blowers; and, WHEREAS, the pe oposed project has been processed pursuant to Section 9-2.301, Development Review of the Land Use Code and reviewed for compliance with the City's General Plan and the City's adopted Architectural Design Guidelines; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to Section 15301 of the California Environmental Quality Act (CEQA) and issued a Class 1 Categorical Exemption; and, WHEREAS, On May 13, 2008 the Planning Commission conducted a duly noticed public meeting pursuant to Section 9-2.313 of the Municipal Code to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings 1. The project plans comply with all provisions of Title 9 of the San Juan Capistrano Municipal Code; and, 2. The architectural and general design of the project is generally consistent with the goals, policies and objectives of the Community Design Element and all other applicable provisions of the General Plan; and, 3. The site plan is compatible with surrounding existing and proposed land uses; 4. The general design considerations, including the character, scale and quality of the design are consistent with the adopted Architectural Design Guidelines of the City; and, 5. The site plan is functional and safe in regards to existing or mitigated off-site conditions as they relate to adequacy of vehicular, bicycle and pedestrian circulation; and, PC Resolution 08-5-13-2 2 May 13, 2008 6. The general landscape design, including the location, type, size, color, texture and coverage of plant materials has been considered to insure visual relief to complement buildings and structure. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby confirm issuance of a categorical exemption and approves the project subject to the following conditions of approval: 1. Motorized Blowers Prior to the final inspection by the Planning Department, the applicant shall remove all blowers off the structure. In the event that the blowers are not removed, the project will be referred to Code Enforcement. 2. Landscape on Fence Prior to the final inspection by the Planning Department, the applicant shall install bougainvillea vines along the fence, located west of the carwash structure. EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become effective following expiration of the fifteen (15) day appeal period without filing of an appeal application. The appeal period shall expire at 5:00 PM, Wednesday, May 28, 2008. This project approval shall be valid for a period of 24 months from the date of approval of this resolution, and shall expire on May 13, 2010 unless a time extension request or building permit application related to this discretionary approval is submitted to the City prior to that date.
