AN ACTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN
CAPISTRANO APPROVING ARCHITECTURAL CONTROL 08-030 FOR A
TEMPORARY PAVED PARKING LOT LOCATED ON THE SOUTH CAMPUS OF
JUNIPERO SERRA HIGH SCHOOL. THE PROJECT SITE IS LOCATED AT 26351
JUNIPERO SERRA ROAD GENERALLY LOCATED AT THE SOUTHEAST CORNER
OF JUNIPERO SERRA ROAD AND CAMINO CAPISTRANO (APN 649-011-025 &
030)( JOHNFRANKEL/JUNIPERO SERRA HIGH SCHOOL)
Whereas, Junipero Serra High School requests approval to legalize a temporary paved
parking lot located on the South Campus which consists of 44 parking stalls and 2
handicap parking stalls and low water use landscaping that includes shrubs and trees
within the parking lot. The subject property has a General Plan Designation of "Public
Institutional' (PI) and is zoned "Public Institutional' (PI); and,
Whereas, the proposed project has been processed pursuant to - Section 9-2.301,
Development Review of the Land Use Code; and,
Whereas, the Environmental Administrator has determined the project to be exempt
from environmental review pursuant to Section 15304, Class 4 (Minor Alterations to
Land) of the California Environmental Quality Act (CEQA) and has prepared a Notice of
Exemption; and,
Whereas, on February 10, 2009, the Planning Commission conducted a duly noticed
public meeting pursuant to Section 9-2.339 of the Municipal Code to consider public
testimony on the proposed project.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of
the City of San Juan Capistrano does hereby approve the project subject to the
conditions of approval set forth in Exhibit A, attached hereto and incorporated herein,
based on substantiation that is provided in the staff report dated February 10, 2009, and
based on the following finding pursuant to the Land Use Code (Section 9-2.349(e)):
1. The temporary parking lot complies with all applicable provisions of Title 9 of the San
Juan Capistrano Municipal Code because it is designed to comply with the
landscape, exterior lighting and water quality requirements as well as the parking lot
regulations; and,
2. The temporary parking lot is consistent with the goals, policies and objectives of the
General Plan, including the Community Design Element because the proposed
landscape palette is designed with low water use trees and groundcover; and,
3. The site is adequate in size and shape to accommodate the temporary parking lot
because it is located on the site of the future Performing Arts Center and will be
removed at such time that the Performing Arts Center is constructed. The parking
lot is designed to fit on the site and to accommodate landscape and lighting
requirements; and,
4. The landscaping is consistent with the adopted Architectural Design Guidelines of
the City because the proposed landscape palette is designed with low water use
trees and groundcover, and is consistent with the City's long-term vision for water
conservation; and,
5. The site plan provides functional and safe vehicular, bicycle and pedestrian access
and circulation because the parking lot site plan is designed with 44 parking spaces
and 2 handicap spaces and provides for a pedestrian walkway from the parking lot
into the south campus; and,
6. The temporary parking lot is compatible with surrounding existing and proposed
land uses and community character, including scale, intensity, massing, architectural
design, landscape design, and other development characteristics because the
project is located adjacent to other existing previously approved parking lots and is
compatible with the overall school uses on the site.
EFFECTIVE DATE & EXPIRATION DATE: This project action shall become final and
effective following expiration of the fifteen (15) day appeal period without filing of an
appeal, and the appeal period shall expire at 5:00 p.m., Wednesday, February 25, 2009.
This project approval shall be valid for a period of 4 years from the date of approval of
this resolution, and shall expire on February 10, 2013.
PASSED, APPROVED AND ADOPTED this 10th day of February, 2009, by the
following vote, to wit:

These conditions of approval apply to AC 08-030, an application to legalize a temporary
paved parking lot located on the South Campus which consists of 44 parking stalls and
2 handicap parking stalls and low water use landscaping that includes shrubs and trees
within the parking lot. The subject property has a General Plan Designation of "Public
Institutional" (PI) and is zoned "Public Institutional" (PI). For the purpose of these
conditions, the term "applicant" shall also mean the developer, the owner or any
successor(s) in interest to the terms of this approval.
General Conditions:
1. AC 08-030 is granted to legalize a temporary paved parking lot located on
the South. Campus which consists of 44 parking stalls and 2 handicap
parking stalls and low water use landscaping that includes shrubs and
trees within the parking lot. The project is approved assubmitted and
conditioned herein, and shall not be further altered unless reviewed and
approved by the affected city departments. Minor modifications to this
approval which are determined by the Planning Director to be in
substantial conformance with the approved tree removal, may be
approved by the Planning Director upon submittal of an application and
the required fee. If not appealed, this approval shall become effective on
the first business day following the fifteenth (15th) day after the date of the
Planning Commission's approval and shall expire February 10, 2013 four
(4) years after the approval date.
2. Approval of this application does not relieve the applicant from complying
with other applicable Federal, State, County or City regulations or
requirements.
3. The applicant shall defend, indemnify, and hold harmless the City of San
Juan Capistrano and its officers, employees, and agents from and against
any claim, action, or proceeding against the City of San Juan Capistrano,
its officers, employees, or agents to attack, set aside, void, or annul any
approval or condition of approval of the City of San Juan Capistrano
concerning this project, including but not limited to any approval or
condition of approval of the City Council, Planning Commission, or City
Planning Commission Resolution 09-2-10-2 Final Conditions of Approval

Planner. The City shall promptly notify the applicant of any claim, action,
or proceeding concerning the project and the City shall cooperate fully in
the defense of the matter. The City reserves the right, at its own option, to
choose its own attorney to represent the City, its officers, employees, and
agents in the defense of the matter.
4. The applicant shall be responsible for informing all subcontractors,
consultants, engineers, or other business entities providing services
related to the project of their responsibilities to comply with. these
conditions of approval and all pertinent requirements in the San Juan
Capistrano Municipal Code, including the requirement that a business
license be obtained by all entities doing business in the City.
5. Prior to the issuance of a Certificate of Occupancy, the applicant shall
submit as -built plans of the recycled water master plan for the parking lot
area.
6. Prior to the issuance of a Certificate of Occupancy, the applicant shall.
contact the Planning Division for an onsite final inspection.
7. The applicant shall complete all improvements within 60 days of approval
otherwise such approval shall be null and void. Applicant may request
one extension only prior to expiration, for not more than 30 additional
days.
8. Prior to the issuance of a Certificate of. Occupancy, the applicant shall
revise and re -submit the landscape plan with tree species (Oaks &
Sycamores) that are California Native; for review and approval by the
Community Development Director.
9. The applicant shall submit a status update no later than February 10, 2011
that describes the schools construction plans for the Performing Arts
Center. Said status shall be submitted in the form of a letter to the
Community Development Director.
