GENERAL PLAN CONFORMITY FINDING
DEL OBISPO STREET -BRIDGE WIDENING AT TRABUCO
CREEK,CHANNEL
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA DETERMINING THAT THE PROPOSED PARCEL CONVEYANCES AND
EASEMENT QUITCLAIMS FOR THE DEL OBISPO STREET -BRIDGE WIDENING AT TRABUCO
CREEK CHANNEL ARE CONSISTENT WITH THE GENERAL PLAN CIRCULATION ELEMENT
(COUNTY OF ORANGE, PUBLIC WORKS DEPARTMENT)
Whereas, the Orange County Public Works Department has requested a General
Plan conformity finding for the proposed conveyance of a remnant parcel to the City in -fee; and
quitclaiming certain flood control, access, and slope easements extending from about 90 feet
upstream of Del Obispo Street to about 490 feet downstream of Del Obispo Street along Trabuco
Creek in the City of San Juan Capistrano; and,
Whereas, the City has previously prepared an initial study pursuant to Section 15063
and 15064 of the CEQA Guidelines, issued a mitigated negative declaration pursuant to Section
15070 of those guidelines; caused a Notice of Negative Declaration to be posted pursuant to
Section 15072 of those guidelines, and has otherwise complied with all applicable provisions of the
California Environmental Quality Act (1970); and,
Whereas, the Planning Commission has considered the proposed project for General
Plan conformity pursuant to California Government Code Section 65402.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of
San Juan Capistrano does hereby make the following findings:
The proposed project is consistent with General Plan Circulation Element Policy 1.1:
Provide and maintain a City circulation system that is in balance with the land uses in San
Juan Capistrano because the proposed Del Obispo Street -Bridge Widening project provides
additional capacity to accommodate traffic demand resulting from new development within
the City; and,
2. The proposed project is consistent with General Plan Circulation Element Policy 1.3:
Coordinate improvements to the City circulation system with other major transportation
improvement programs because the proposed project has been coordinated with recently
completed street capacity improvements including the Camino Capistrano -Del Obispo Street
intersection improvements and Del Obispo Street widening (Calle Aspero to Aguacate)
3. The proposed project is consistent with General Plan Circulation Element Policy 1.6:
Reduce the congestion along local arterial roadways in commercial areas by driveway
access consolidation, parking area interconnections and similar actions because the project
.will reduce congestion resulting from heavy traffic demand at Del Obispo Street-Alipaz Street
and the lack of left -turn lane capacity, and the proposed parcel conveyance and easement
quitclaims are appropriate and necessary as part of the implementation of the proposed
project

NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission
of the City of San Juan Capistrano hereby finds and determine that the proposed project will be
consistent with the General Plan pursuant to Section 65402 of the California Government Code
PASSED, APPROVED AND ADOPTED this 8t" day of February, 2011, by the
following vote, to wit:
AYES: Chairman Sheldon Cohen and Commissioners Ginny Kerr, Jeff Parkhurst,
Timothy Neely, Gene Ratcliffe and Rob Williams.
