PC Resolution-11-11-22-01PC RESOLUTION NO. 11-11-22-01 CONDITIONAL USE PERMIT (CUP) 10-014 SAN JUAN HILLS GOLF COURSE A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA DENYING "OUTDOOR RECREATIONAL LIGHTING" AT THE EXISTING DRIVING RANGE LOCATED AT 32111 SAN JUAN CREEK ROAD (ASSESSORS PARCEL NUMBER: 660-011-27)(SAN JUAN HILLS GOLF CLUB) Whereas, San Juan Hills Golf Club, 32120 San Juan Creek Road, has requested approval of Conditional Use Permit (CUP)10-014 to allow "outdoor recreational lighting" consisting of a Musco Light -Green Structure System consisting of light fixtures mounted on the existing net poles on both sides of the driving range at 50 feet in height. These lights would be 1500 watt metal halide lamps. Poles P1 -P5 would feature 14 -inch visors and poles P6 -P10 would feature 5 -inch visors. Three additional light poles and fixtures at a height of 25 feet would be placed between the existing parking lot and tee boxes. These would be Lithonia "shoebox style" fixtures with 1500 watt metal halide lamps with a full shield on property located at 32111 San Juan Creek Road which is General Plan -designated 1.1 Open Space Recreation and classified as OSR (Open Space Recreation) on the Official Zoning Map; and, Whereas, San Juan Hills Golf Club is the owner of real property located at 32111 San Juan Creek Road and generally located on the north side of San Juan Creek Road approximately 2,200 feet east of 1-5, APN 660-011-27; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development Review of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the initial study prepared pursuant to Section 15063 and 15064 of the CEQA Guidelines, has issued a negative declaration pursuant to Section 15070 of those guidelines; has caused a Notice of Negative Declaration to be posted pursuant to Section 15072 of those guidelines, and has otherwise complied with all applicable provisions of the California Environmental Quality Act (1970); and, Whereas, the Design Review Committee conducted three work sessions on February 3, 2011, March 17, 2011, and September 1, 2011, and recommended restriction of hours earlier than 10:00 pm and consideration of a "south -side illumination only" alternative; and, Whereas, the Planning Commission conducted a worksession on October 11, 2011 and a duly -noticed public hearing on November 22, 2011 pursuant to Title 9, Land Use Code, Section 9-2.302, City Council Policy 5, and Planning Department Policy 510 to PC Resolution 11-11-22-01 2 November 22. 2011 consider public testimony on the proposed project and has considered all relevant public comments. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings: (1) The proposed project is inconsistent with the General Plan, specifically the Community Design Element, which states that night lighting shall be minimized along Interstate -5 because the proposed driving range lights would be clearly visible from Interstate -5 and cause excessive glare and a night-time "halo" effect. (2) The proposed project is consistent with the purpose, intent, and standards of the Land Use Code, including the Open Space Recreation (OSR) district because the existing driving range was previously determined to be consistent as part of the original approval. Furthermore, the project is consistent with the standards of Table 3-27 of Section 9-3.529, Lighting Standards of the Title 9 Land Use Code, because all lighting levels would be at or below Code -required levels. (3) Because the project site has been previously determined to be adequate in size and shape to accommodate a driving range and the proposed recreational lighting project includes no modifications to the approved site plan, this criteria is not applicable to the proposed project. (4) The operation of the proposed lighted driving range facility would be incompatible with abutting residential and institutional land uses by producing excessive additional lighting which would potentially affect residents of adjacent properties, especially including the San Juan Hills West neighborhood to the south, and the Atria San Juan senior living facility to the west, as well as motorists on San Juan Creek Road. (5) The site presently provides adequate access and parking and the proposed project does not propose any modifications that would alter the existing access and parking. Therefore, this criteria is not applicable. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission does hereby deny a Conditional Use Permit for `outdoor recreational lighting" at San Juan Hills Golf Course since Section 9-2.317 requires the Planning Commission to make all findings referenced above. EFFECTIVE DATE & FINAL ACTION: This project denial shall become effective following expiration of the fifteen (15) day appeal period without filing of an appeal application. The appeal period shall expire at 5:00 pm, Wednesday, December 7, 2011.
