PC Resolution-11-05-24-01PC RESOLUTION NO. 11-05-24-1 SIGN PERMIT (SP) 11-013, INDEPENDENCE BANK A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA DENYING THE CONSTRUCTION OF A MONUMENT SIGN FOR THE INDEPENDENCE BANK BUILDING LOCATED AT 32291 CAMINO CAPISTRANO (APN 668-091-07) (INDEPENDENCE BANK) Whereas, Larry Thomas, property owner, has requested approval of sign permit (SP 11-013) to allow a monument sign to be constructed adjacent to Camino Capistrano on property located at 32291 Camino Capistrano which is General Plan - designated General Commercial (GC) and classified as General Commercial (GC) on the Official Zoning Map; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development Review of the Land Use Code; and, Whereas, the Planning Commission conducted a duly -noticed public meeting on May 10, 2011 and on May 24, 2011 pursuant to the provisions of Title 9, Land Use Code, Section 9-2.339, Public Meeting Procedures, Administrative Policy 409, and Planning Department Policy 510 to consider public testimony on the proposed project and has considered all relevant public comment. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano finds: The proposed monument sign does not comply with criteria (A)(i) of the City's Municipal Code Section,9-3.543 which states that signs `Be used to identifytenants when building setbacks, orientation or design make it difficult to provide other types of signage, such as wall signs, that are plainly visible to people that are trying to identify a use. The primary function is to provide project or tenant identification". The monument sign does not satisfy these criteria because the building has existing "plainly visible" wall signage that was recently mounted on the building elevation that fronts Camino Capistrano; and, 2. The subject property does not meet the municipal code definition for a "shopping center". The definition describes a shopping center as "A group of more than two (2) retail stores and service establishments designed to serve customers as a single unit with shared access and common parking". The subject site does not meet the definition because it is a separate parcel from the Vons shopping center but has one building/service establishment on the parcel; therefore not qualifying for its own monument sign; and, 3. The subject property does not meet the municipal code criteria for a freestanding monument sign because the subject property shares common driveway access and PC Resolution 11-05-24-1 2 May 24, 2011 common parking with other establishments and is thus within a shopping center; therefore an individual freestanding monument sign is not permitted. 4. Based on the findings above, the proposed monument sign does not comply with finding (A) of the City's Municipal Code Section 9-2.343 which states that "The proposed sign (s) is consistent with. the design criteria of Section 9-3.543, Signs, the Community Design Element, and the Design Guidelines". NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby denies the proposed monument sign, and the Planning Director, or designee, is directed to provide a written statement to the applicant stating the reasons_for the denial as required per Section 9-2.343(b)(4). EFFECTIVE DATE & FINAL ACTION: This project action shall become final and effective following expiration of the fifteen (15) day appeal period without filing of an appeal, and the appeal period shall expire at 5:00 p.m., Wednesday, June 8, 2011.
