PC Resolution-12-06-26-03PC RESOLUTION NO. 12-06-26-03 GENERAL PLAN AMENDMENT (GPA) 12-001 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA RECOMMENDING DENIAL OF AN AMENDMENT TO THE GENERAL PLAN LAND USE MAP DESIGNATIONS FOR AN EXISTING 20.64 ACRE PROPERTY LOCATED AT 31000 AVENIDA SIEGA (APN: 664-041-07, 08,.09, & 10): (THE OAKS) Whereas, Shea Homes, Inc., 1250 Corona Pointe Court, Suite 600, Corona, CA 92879, has requested approval of General Plan Amendment (GPA) 12-001 to allow amendment to the General Plan Land Use Map changing the land use designation boundaries to shift the "2.2 Medium Low Density" designation to the western portion of the project site and the 1.0 General Open Space" designation to the eastern portion of the project site on property located at 31000 Avenida Siega, generally located east of the southern terminus of Avenida Siega, and south of Ortega Highway approximately 3,400 feet west of La PataAvenue (APN: 664-041-07, 08, 09, & 10), and classified as RS -10,000 and OSR on the Official Zoning Map; and, Whereas, the City Council initiated consideration of the General Plan Amendment on March 20, 2012; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development Review of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the initial study prepared pursuant to Section 15063 and 15064 of the CEQA Guidelines, has issued a negative declaration pursuant to Section 15070 of those guidelines; has caused a Notice of Negative Declaration to be posted pursuant to Section 15072 of those guidelines, and has otherwise complied with all applicable provisions of the California Environmental Quality Act; and all mitigation measures have been included herein; and, Whereas, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental QualityAct (CEQA), has considered all project environmental documentation and technical studies; and, Whereas, the Planning Commission conducted a duly -noticed public hearing on June 26, 2012 pursuant to Title 9, Land Use Code, Section 9-2.302, City Council Policy 5, and Planning Department Policy 510 to consider public testimony on the proposed project and has considered all relevant public comments; and, NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings as established by Section 9-2.307 of Title 9, Land Use Code of the City of San Juan Capistrano: PC Resolution 12-06-26-04 2 June 26, 2012 1. The project would not be consistent with the goals, policies, and recommendations of the General Plan because it would not preserve important open space designated lands identified under the current General Plan Land Use Policy Map. More specifically, the project would eliminate important open space views of the property from the existing San Juan Creek Trail and from trail users. 2. The application does not contain sufficient information to fully evaluate whether the project is consistent with the General Plan. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby recommends that the City Council deny the proposed project.
