A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA RECOMMENDING CITY COUNCIL APPROVAL OF
GENERAL PLAN AMENDMENT (GPA) 13-006, AND REZONE (RZ) 13-004 AMENDING
THE LAND USE MAP DESIGNATION AND THE OFFICIAL ZONING MAP DESIGNATION
FOR THE 1.0 ACRE SITE LOCATED AT 29582 SPOTTED BULL LANE (ASSESSOR
PARCEL NUMBER: 650-011-27)(LES GILMER)
WHEREAS, in December 1999, the City adopted the revised General Plan
and Land Use Policy Map and Official Zoning Map which established 29582 Spotted Bull
Lane as a Public & Institutional Land Use and Zone; and
WHEREAS, staff has found that the December 1999, General Plan and Land
Use Policy Map and Official Zoning Map which revised 29582 Spotted Bull Lane
inadvertently changed the designation of the property.
WHEREAS, the proposed General Plan Amendment and Rezone has been
processed pursuant to Section 9-2.302, Title 9 of the Municipal Code; and
WHEREAS, the Environmental Administrator has reviewed the project
pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and
determined that the project is exempt from review in accordance with Section 15061 (b)(3);
and
WHEREAS, on December 10, 2013, the Planning Commission conducted
public meetings to receive public testimony on the contents of the General Plan Amendment
and Rezone and forwarded a recommendation of approval to the City Council; and,
NOW, THEREFORE, BE IT RESOLVED, Planning Commission finds the
proposed General Plan Amendment and Rezone consistent with the General Plan Land
Use Map designation and the requirements for findings as outlined in the Land Use Code,
Title 9.
NOW THEREFORE BE IT FURTHER RESOLVED, that the Planning
Commission of the City of San Juan Capistrano hereby recommends City Council approval
of General Plan Amendment (GPA) 13-006 as provided by Exhibit A attached hereto and
incorporated herein; and, Rezone (RZ) 13-004 as provided by Exhibit B attached hereto and
incorporated herein.
PASSED, APPROVED AND ADOPTED this 10th day of December, 2013, by
