PC Resolution-13-01-30-01PC RESOLUTION NO. 13-01-30-01 ARCHITECTURAL CONTROL (AC) 12-025 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA APPROVING A SIGN PROGRAM FOR THE MISSION SAN JUAN CAPISTRANO GATE HOUSE LOCATED AT 26801 ORTEGA HIGHWAY (ASSESSORS PARCEL NUMBER: 124-180-06) (MISSION SAN JUAN CAPISTRANO SIGN PROGRAM) Whereas, Matt McKinlay, 5100 Birch Street, Suite 100, Newport Beach, CA 92660 has requested approval of a Sign Program for Architectural Control (AC) 12-025 to allow 2 hand -painted wall signs at 14.9 square feet and 4.9 square feet on property located at 26801 Ortega Highway, which is General Plan -designated 5.0 Public & Institutional and classified as Public & Institutional on the Official Zoning Map; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development Review of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and determined that the project qualifies for a Class 11 categorical exemption, and will cause the Notice of Exemption to be posted pursuant to Section 15061(d) of the CEQA Guidelines; and, Whereas, the Planning Commission has considered the Environmental Administrator's determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA); and, Whereas, the Design Review Committee conducted a duly -noticed public meeting on January 17, 2013, pursuant to the provisions of Title 9, Land Use Code, Section 9-2.302, Public Meeting Procedures and City Council Resolution 10-08-17-03 to consider public testimony on the proposed project and forwarded the project to the Planning Commission with a favorable recommendation; and, Whereas, the Planning Commission conducted a duly -noticed public meeting on January 30, 2013, pursuant to the provisions of Title 9, Land Use Code, Section 9- 2.302, Public Meeting Procedures and City Council Resolution 10-08-17-03 to consider public testimony on the proposed project and has considered all relevant public comment. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of San Juan Capistrano does hereby make the following findings as established by Section 9-2.343(c)(3) of Title 9, Land Use Code of the City of San Juan Capistrano: PC Resolution 13-01-30-01 2 January 30, 2013 The sign program is consistent with the General Plan and Design Guidelines, and is complementary to the architecture and design of the development project because they would be consistent with the overall scale of the building and would feature a single color (dark brown -red) and fairly uniform font style; and, 2. The sign program conforms to all applicable requirements of this Code and any applicable specific plan or comprehensive development plan because it would be less than the maximum sign square footage allowed in the Public & Institutional zone district and the hand -painted style is permitted pursuant MC Section 9-3.547; and, 3. The sign program is generally compatible with the design character of adjacent properties and/or rights-of-way because it does not conflict with any other styles or colors seen at adjacent properties and the hand -painted style is determined to be appropriate for the Downtown. THE PLANNING COMMISSION FURTHER FINDS: The founding date of Mission San Juan Capistrano is significant and should be of equal size to the "Worth a Visit" quote in the proposed signage. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Planning Commission of the City of San Juan Capistrano hereby approves the Sign Program as depicted in the plans dated December 20, 2012. EFFECTIVE DATE & FINAL APPROVAL: This project approval shall become effective following expiration of the fifteen (15) day appeal period without filing of an appeal application. The appeal period shall expire at 5:00 pm, Thursday, February 14, 2013. This project approval shall be valid for a period of 5 years from the date of approval of this resolution, and shall expire on January 30, 2018, unless a time extension request or building/grading permit application related to this discretionary approval is submitted to the City prior to that date. PROTEST OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS: Pursuant to Government Code Section 66020, the applicant may protest the imposition of fees, dedications, reservations or other exactions imposed on this development project by taking the necessary steps and following the procedures established by Sections 66020 through 66022 of the California Government Code.
