WHEREAS, Eric Altman, has requested approval of a final extension of time
to Architectural Control (AC) 06-12 for the addition/remodel of the existing building
including the "protection -in-place" of the front fagade of the existing building which is
located along Verdugo Street; and specifically located at 26755 Verdugo Street in the TC
(Tourist Commercial) Zone District (generally located on the east side of "The Santa Fe
Rail Depot" and north of the Franciscan Plaza -Celebrity Theaters and which is General
Plan -designated 3.1 -General Commercial on the General Plan Land Use Map; and,
WHEREAS, the proposed project has been processed pursuant to Section 9-
2.301, Development Review of the Land Use Code; and,
WHEREAS, the applicant has not proposed any changes to the project as
approved by the San Juan Capistrano City Council on April 15, 2008; and,
WHEREAS, The City's Environmental Administrator has determined that the
Mitigated Negative Declaration (MND) that was certified by the City Council on April 15,
2008, meets all requirements of the California Environmental Quality Act (CEQA), and has
determined that no further environmental review is necessary, because the project is
consistent with the planned use of the site in the prior MND; and,
WHEREAS, the City Council conducted a duly noticed public hearing on April
15, 2008 pursuant to Section 9-2.339 of the Municipal Code to consider public testimony
on the proposed project; and,
WHEREAS, the Zoning Administrator has considered all oral and written
testimony offered at the public hearing; and,
NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the
City of San Juan Capistrano does hereby make the following findings:
The proposed project is consistent with the policies and objectives of the San Juan
Capistrano General Plan; and,

2. The proposed project complies with all applicable provisions of the Land Use Code
subject to the mitigation measures and conditions of approval contained in this
resolution; and,
3. The project is consistent with the City's adopted Architectural Design Guidelines;
and,
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Zoning
Administrator of the City of San Juan Capistrano hereby grants approval of a one (1) year
extension of time to Architectural Control 06-12, subject to the conditions of approval
established by City Council Resolution 08-04-15-03, attached hereto and incorporated
herein as Exhibit A and shall expire on April 15, 2013 unless the applicant commences
construction of the project as described herein.
EFFECTIVE DATE & FINAL APPROVAL: Pursuant to Section 9-2.311 of
Title 9, Land Use Code, this project approval shall become effective following expiration of
the fifteen (15) day appeal period without filing of a valid appeal application. The fifteen
(15) day appeal period shall expire at 5:00 p.m. on Thursday, May 24, 2012.
