ZA Resolution-12-03-07-01RESOLUTION NO. 12-03-07-01 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SAN JUAN CAPISTRANO APPROVING A 12 -MONTH TIME EXTENSION OF ZONING ENTITLEMENTS FOR ARCHITECTURAL CONTROL (AC) 11-03 FOR A 4,859 SQUARE FOOT (GSF) WESELOH-KIA SERVICE BAY BUILDING ON AN EXISTING 7.02 ACRE PARCEL LOCATED AT 33611 CAMINO CAPISTRANO AND MOTRE PRECISELY REFERRED TO AS ASSESSOR PARCEL NUMBER (APN) 121-254-41 (WESELOH-KIA) WHEREAS, John Morgan, representative for the applicant, has requested a twelve month time extension for Architectural Control (AC) 11-03 in order to develop the Weseloh-Kia Service Bay Building project authorized to develop a 4,859 square foot service building with 8 service bays; and, 'WHEREAS, Weseloh Family Ltd. Partnership is the owner of real property located at 33611 Camino Capistrano, San Juan Capistrano, CA (APN 121-254-41); and, WHEREAS, a Notice of Exemption was posted in accordance with the California Environmental Quality Act (CEQA) Guidelines; and, WHEREAS, the project is consistent with the City's adopted Architectural Design Guidelines; and WHEREAS, the zoning entitlements forthe project would otherwise expire on March 1, 2012 if not extended by the Zoning Administrator who is authorized by the Title 9, Land Use Code to extend such entitlements for twelve (12) months per request up to a maximum of five (5) years from the original approval pursuant to Municipal Code Section 9- 2.313(e); and, WHEREAS, the Zoning Administrator of the City of San Juan Capistrano is granted the authority to approve time extensions pursuant to Municipal Code section 9- 1.11(d)(2); and WHEREAS, this public hearing was duly noticed in a local newspaper and was mailed to property owners within 1,000 feet of the subject property; and, WHEREAS, the Zoning Administrator has considered all oral and written testimony offered at the public hearing; and, NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator hereby makes the following findings: 1. The project applicant has not proposed any changes to the project as approved by the Development Services Director on March 1, 2011; and, ZA Resolution 12-03-07-01 2 March 7 2012 2. Neither the policies of the City's General Plan Land Use Element nor the provisions of Title 9, Land Use Code have changed so as to create inconsistencies or non - conformities; and, 3. The project is consistent with the Quasi -Industrial land use designation on the General Plan Land Use Map; and, 4. The project is consistent with the CM (Commercial Manufacturing) zone district and more specifically, the permitted uses and development standards set forth in Municipal Code Section 9-3.305; and, 5. The project is consistent with the City's adopted Architectural Design Guidelines. NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano grants a time extension of twelve (12) months subject to conditions of approval set forth in the Administrative Approval dated March 1, 2011. NOW, THEREFORE, BE IT FURTHER RESOLVED that the zoning entitlements for the Weseloh Kia Service Bay Building project shall expire on March 1, 2013 unless an additional extension of time is granted or the applicant has obtained building permits and commenced construction. EFFECTIVE DATE & FINAL APPROVAL: The decision of the Zoning Administrator shall become final on March 22, 2012 at 5:30 p.m. if an appeal has not been filed prior to that date and time.
