ZA Resolution-07-01-04-01ZA RESOLUTION NO. 07-01-04-1 DEVELOPMENT STANDARDS ADJUSTMENT 06-13 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SAN JUAN CAPISTRANO APPROVING A DEVELOPMENT STANDARDS ADJUSTMENT TO ALLOW THE CONSTRUCTION OF A FIRST FLOOR ADDITION THAT INCREASES THE LOT COVERAGE TO 16.5% WHERE THE MUNICIPALCODE ESTABLISHESTHE MAXIMUM LOT COVERAGE AS 15%, LOCATED AT 27946 SUFFOLK (APN 650-321-21); BUCKANAVAGE RESIDENCE Whereas, David Buckanavage requests approval of a Development Standards Adjustment to Section 9-3.301 (Residential Districts Development Standards) of the Land Use Code to allow the construction of a first floor addition that increases the lot coverage to 16.5% where the municipal code establishes the maximum lot coverage as 15%. The property is General Plan designated as VLD (Low Density- 0 to 1 Dus/Acre), and is designated as RSE-40,000" Single Family Residential on the Official Zoning Map; and, Whereas, the proposed project has been processed pursuant to Section 9- 2.301, Development. Review of the Land Use Code; and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA), and has issued a Class 1 (e) (Existing Facilities) Categorical Exemption; and, Whereas, Zoning Administrator conducted a duly noticed public meeting on August 17, 2006 pursuant to Section 9-2.313 of the Municipal Code to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano does hereby make the following findings: 1. The requested adjustment is the most practical solution to the proposed project because it will allow the applicant to construct an addition that is similar and not out of character of the existing neighborhood. Due to the manner in which the. Hunt Club was designed, individual lots have specific maximum building heights and setbacks, per Specific Plan 77-01. Lot coverage was not included into the specific plan and does not provide a mechanism to regulate the lot coverage. Therefore, the result is the application of a hybrid of base standards and specific standards being applied to individual lots. In the case of the Buckanvage residence, the specific height restriction prohibits the ability of the homeowner to add a second story, where many homes in the Hunt Club have two stories. The application of the RSE 40,000 lot coverage restricts the applicant from making additions similar in size and scale to surrounding homes. By allowing the 10% deviation to the lot coverage standard, it will allow the applicant to share the same rights and privileges as neighboring properties. The proposed project will not adversely affect the adjoining properties because the proposed addition is being built in the rear of an existing structure, and being tucked into the hillside. In addition the existing structure and proposed addition meet the required setbacks as set forth in the Municipal Code. Due to the size, scale and location of the addition, it's impact on the surrounding community would be minimal. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Zoning Administrator of the City of San Juan Capistrano hereby approves the project subject to the conditions of approval contained in Exhibit "A" attached hereto and incorporated herein; and, EFFECTIVE DATE & FINAL APPROVAL: Pursuant to Section 9-2.311 of Title 9, Land Use Code, this project approval shall become effective following expiration of the fifteen (15) day appeal period without filing of a valid appeal application. The fifteen (15) day appeal period shall expire at 5:00 p.m. on Friday January 19, 2007. This project approval shall be valid for a period two (2) years from the date of approval of this resolution and shall expire on January 4, 2009 unless a time extension request has been submitted to the City; or a building/grading permit application has been submitted to the City; or in the case of a conditional use permit, the use has been established prior to the approval expiration date.
