A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN
JUAN CAPISTRANO RECOMMENDING CONDITIONAL APPROVAL OF A SITE PLAN
REVIEW (SPR) MODIFICATION, CONDITIONAL USE PERMIT (CUP), AND ZONE
VARIANCE (ZV) FOR RECONSTRUCTION OF AN EXlSTlNG STRUCTURE ON AN 0.10
ACRE PARCEL LOCATED AT 31921 LOS RIOS STREET AND MORE PRECISELY
REFERRED TO AS ASSESSORS PARCEL NUMBERS 121-160-08, 32, AND 33.

Whereas, Louella Jean and George Fernandez request approval of site plan
modificatrons to reconstruct an existing I, 108 square foot residential structure with 958
square foot building addition and 176 square foot covered porch; approval of a variance
to allow an 0.475 floor area ratio (FAR) whereas the Specific Plan establishes a maximum
0.40; and approval of a conditional use permit to allow a “secondary dwelling unit” located
at 31921 Los Rios Street in the “HR” (historic resrdential”) of the Los Rios Specific Plan;
and,
Wereas, the proposed project has been processed pursuant to Section 9-
2.301, Development Review of the Land Use Code and Article 4.1 of the Los Rios Precise
Plan; and,
Whereas, the Environmental Coordinator has reviewed the project pursuant
to Section 15061 of the California Environmental Quality Act (CEQA) and issued a Class
2 categorical exemption and caused a Notice of Exemption to be posted pursuant to the
City’s Environmental Review Guidelines, and has otherwise complied with all applicable
provisions of the California Environmental Quality Act (CEQA); and,
Whereas, the Cultural Heritage Commission has considered the
Environmental Coordinator’s determination pursuant to Section 15074 of the California
Environmental Quality Act (CEQA); and,
Whereas, the Cultural Heritage Commission conducted a duly noticed public
meeting on August 24, 1999 pursuant to Section 9-2.313 of the Municipal Code to consider
public testimony on the proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage
Commission of the City of San Juan Capistrano does hereby make the following findings:
1. The proposed project is consistent with the policies and objectives of the San
Juan Capistrano General Plan, specifically, the Land Use Element and
Historic Archeological Element, and,

2. The proposed project complies with all applicable provisions of Title 9, Land
Use Code subject to the conditions of approval contained in this resolution;
and,
3. The proposed project complies with all applicable provisions of the Los Rios
Precise Plan Title 9, Land Use Code subject to the conditions of approval
contained in this resolution.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural
Heritage Commission of the City of San Juan Capistrano does hereby confirm the issuance
of a categorical exemption and recommends approval of the project subject to the following
conditions of approval.
1. Reconstruction of the residential structure, including building permit plans, shall
substantially comply with the plans submitted July 20, 1999, as conditionally
approved, subject to the satisfaction of the Planning Director or his designee.
2. The project shall provide a minimum sideyard (north) of 3’-0” or the Uniform
Building Code (UBC) minimum standard, whichever is greater. The minimum
rear-yard setback shall be IO’-0”.
3. Battens shall be 1x2 or 1x3 nominal dimension stock applied twelve (12) inches on-
center. Corners of the structure shall be flnrshed with 1x6 nominal dimensioned
stock.
4. Lattice skirting shall be fabricated of wood material and painted to match the
exterior house color (i.e. “Navajo white”). Building corners where the lattice meets
shall be finished with corner trim.
5. Windows and doors shall be wood-frame construction and shall be the same as or
comparable to existing windows/doors with respect to dimensions and configuration.
Building permit plans shall include manufacturer specifications for all windows and
doors, subject to review and approval by the Planning Director or his designee.
6. Both dwelling units shall be retained in the same fee-simple ownership and shall not
be held in separate ownership, either fee-simple or condominium.
