CHC Resolution-99-05-25-01- CHC RESOLUTION NO. 99-5-25-l MODIFICATION TO SITE PLAN REVIEW 98-01 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO RECOMMENDING CONDITIONAL APPROVAL OF A MODIFICATION TO A SITE PLAN REVIEW APPLICATION FOR PROPERTY LOCATED AT 31600 LOS RIOS STREET AND MORE PRECISELY REFERRED TO AS ASSESSORS PARCEL NUMBER 121-142-13 (MCKINLEY HOUSE/APPLE ROSE COTTAGE). Whereas, Dona Helmick and Denise Miner have requested approval of a modrficatron to the previously approved site plan review application to allow a cupola on the roof of the existing dwelling (McKinley house), to allow five (5) pole-mounted, carnage lamps along the walkway and around the parking area, and to allow the existing accessory building in the southwest corner of the lot to be used for woodworking shop purposes on an existing lot located in the Historic Residential (HR) District; and, Whereas, the proposed project has been processed pursuant to Section 9-2 301, Development Review of the Land Use Code, and, Whereas, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and has Issued a categorical exemption and caused a Notice of Exemption to be posted pursuant to the City’s Environmental Review Guidelines, and any mitigation measures have been included herein as conditions of approval, and has otherwise complied with all applicable provrslons of the California Environmental Quality Act (CEQA), and, Whereas, the Cultural Heritage Commissron has considered the Environmental Admlnlstrator’s determination pursuant to Section 15074 of the California Environmental Quality Act (CEQA), and conducted a duly noticed public meeting on May 25, 1999 pursuant to City Council policy to consider public testimony on the proposed project. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commisslon of the City of San Juan Capistrano does hereby make the following findings: 1. The proposed site plan review application, including site plan and architectural design, is consistent with the policies and objectives of the San Juan Capistrano General Plan, and the purpose and intent of the Los Rios Precise Plan subject to the conditions of approval contained in this resolutron; and, 2. The proposed site plan review application is consistent with the requirements of the “Historic Residential” (“HR”) District, the Site Design Standards; the Architectural Design Guidelines of the of the Los Rios Precise Plan subject to the condltrons of approval contained in this resolution, and, CHC Resolution 99-5-25-l 2 May 25,1999 3 The proposed site plan review applicatron complles with all applicable provisions of the Land Use Code subject to the conditions of approval contained in this resolution. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby recommends denial of the proposed roof-mounted cupola; and approval of the other modifications to the site plan review application subject to the following conditions: 1. Following expiration of the Planning Commission appeal period without the frllng of an appeal, the applicant shall remove the cupola from the roof of the main structure 2. Within thirty (30) days of Planning Commissron approval, the project will submit an alternative lighting plan which incorporates a more traditional lighting fixture (e.g. cannery-style lamp or similar). No more than two pole-mounted lighting fixtures will be permitted. The lighting plan will be subject to review and approval by the Planning Director who may refer the plan to the Planning Commission for determination WIthIn thirty (30) days of approval of the lighting plan, the project will Install lighting improvements consistent with the approved lighting plan. 3. The proposed “woodworking shop” shall be limited to the existing tin accessory building situated at the northwest corner of the property. The use of all power tools shall be limited to the interior of the “wood workshop”. Prior to use of that building as a “wood workshop”, the applicant shall install insulation and drywall, consistent with contemporary construction methods, in order to provide noise attenuation Windows and doors shall remained completely closed during anytime that any power tool(s) are In use. The applicant shall be permitted to re-construct the tin accessory building to improve the structural integrity of that building however, the location, floor area, height, roof-style and building mass shall be the substantially consistent with the existing accessory building. The project shall neither demolish nor remove the existing tin accessory building until the project has secured approval from the City of building plans to reconstruct that structure. The project will salvage the corrugated-tin for reuse on the reconstructed accessory bulldIng. (this condition supercedes condition #9 of Planning Commission Resolution 98-7- 14-1) 4. The design of the proposed driveway, parking spaces, and walkway along the front (east) and right side (north) of the dwelling shall consist of decomposed granite, pea gravel, exposed aggregate, paving block or similar material subject to review and approval by the Plannrng Director or his designee. The use of asphalt IS discouraged but may be permitted for driveways and parking. Concrete shall be prohibited (this condition supercedes condition #6 of Planning Commission Resolution 98-7-14-1) .
