SHEA THERAPEUTIC RIDING CENTER HISTORIC DEPICTION PROGRAM ARCHITECTURAL CONTROL 03-08 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING THE HISTORIC DEPICTION PROGRAM FOR ARCHITECTURAL CONTROL 03-08 (J. F. SHEA THERAPEUTIC RIDING CENTER) Whereas, on November 9, 2004, the Planning Commission approved Architectural Control 03-08 to allow the expansion of an existing equestrian facility by allowing the construction of covered arenas, offices, therapy/training facilities and service buildings with the removal of some existing buildings located at 26284 Oso Road generally located south of Oso Road and approximately 100 feet west of Avenida de la Vista, Assessor's Parcel Nos. (APNs) 121-07-19, -32 & -34; and, Whereas, City Council Policy No. 606 requires new development projects to prepare and have approved a Historic Depiction Program (NDP) in order to protect and preserve the City's unique cultural, historical, political, architectural and economic heritage; and, Whereas, on January 20, 2010, J. F. Shea Therapeutic Riding Center, 26284 Oso Road, San Juan Capistrano, CA 92675, prepared and submitted a HDP for consideration; and, Whereas, on Tuesday, February 23, 2010, the Cultural Heritage Commission considered the HDP and heard public input on the application. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings with respect to the J. F. Shea Therapeutic Riding Center Historic Depiction Program. 1, The Cultural Heritage Commission hereby finds that the Historic Depiction Program for the J. F. Shea Therapeutic Riding Center project is consistent with the intent of City Council Policy #606, and meets the adopted HDP Review Criteria. 2. The J. Shea Therapeutic Riding Center HDP is consistent with the goals, policies and objectives of the San Juan Capistrano General Plan's Cultural Resources Element because the HDP provides accurate, appropriate and historical information that is accessible to the general public. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby approves the J. F. CHC Resolution 10-2-23-1 2 February 23, 2010 J. F. Shea Center HDP (AC 03-08) Shea Therapeutic Riding Center NDP subject to the conditions in Exhibit A attached hereto and incorporated herein. F. Shea Therapeutic Riding Center HDP APPROVAL DATE: February 23, 2010 EFFECTIVE DATE: March 11, 2010 These conditions of approval apply to the Historic Depiction Program (HDP) for the J. F. Shea Therapeutic Biding Center (AC 03-08). Any proposed modifications to the HDP shall be submitted to the City Community Development Department for review. For the purpose of these conditions, the term "applicant" shall also mean the developer, the owner or any successor(s) in interest to the terms of this approval. 1. The applicant shall make any modifications or corrections approved by the CHC below and shall submit the final layout for the approval of the Historic Preservation Manager prior to fabrication and installation. a. The word "barbeques" shall be changed to "barbecues." b. At the second paragraph, the phrase "on March 20, 1953" shall be deleted. c. References to "Shea Family" shall be changed to "J.F. Shea Co., Inc." d. The overall layout of text and photographs shall be revised to improve the reading flow. 2. The applicant shall comply with the requirements of the conditions imposed by the Planning Commission resolution including installation of the HDP per this approval. The applicant shall call for an inspection of the completed NDP by the Historic Preservation Manager (HPM), and the HDP shall be approved by the HPM, prior to release of the bond. 3. The applicant or successors shall be responsible for perpetual maintenance of the HDP in a pristine condition for the life of the development project.
