A RESOLUTION OF THE CULTURAL HERITAGECOMMISSION OF THE CITY OF SAN JUAN
CAPISTRANO DENYING AN ADDITION AT 31501 LA MATANZA STREET, MORE PRECISELY
REFERRED TO AS ASSESSORS PARCEL NUMBER 124-203-43 (CC McCARY HOUSE
ADDITION)
Whereas, on April 13, 2009, a site plan review application was filed by the Applicant,
David and Reagan Ewing, 31501 La Matanza Street, San Juan Capistrano, CA 92675 for a second
story addition to an existing historic house, and on May 7, 2009, was deemed to be complete by the
City; and
Whereas, the Cultural Heritage Commission conducted a noticed public hearing on
May 26, 2009, pursuant to the provisions of Title 9, Land Use Code, Sections 9-2.327 and 9-
2.302(f), to consider public testimony on the proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of
the City of San Juan Capistrano does hereby make the following findings:
(1) The proposed site design is not compatible with the historic nature of the site,
surrounding district and/or historic period represented by the landmarkbecause:
a. The project is too massive for the area.
b. The project will not preserve the existing character of the area.
EFFECTIVE DATE: This project denial shall become final following expiration of the
fifteen (15) day appeal period without filing of an appeal application. The appeal period shall expire
at 4:30 pm, Wednesday, June 10, 2009.
PASSED, APPROVED AND ADOPTED this 26th day of May, 2009, by the following
vote, to wit:
AYES: Commissioner Tryon, Vice Chair Siegel and Chair Banda

ABSTAIN: None
ABSENT: Commissioners Nunez and Porter
