CHC Resolution-08-07-29-01RESOLUTION NO. 08-7-29-1 CAPISTRANO VILLAGE CENTER (SOLANA RINCON) HISTORIC DEPICTION PROGRAM ARCHITECTURAL CONTROL (AC) 06-13 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING THE HISTORIC DEPICTION PROGRAM FOR AC 06-13, CAPISTRANO VILLAGE CENTER (SOLANA RINCON) Whereas, on July 24, 2007, the City approved an a pplication for an architectural control for a new 3,300 square foot single story retail/office building on a 9,000 square foot parcel and upgrades to the landscape and parking lot for the existing buildings on the two adjacent lots to the north located at the corner of Avenida Padre and Camino Capistrano and further described as Assessor's Parcel Nos. 668-453-12, -13, -14 and -15; and Whereas, City Council Policy No. 606 requires new development projects to prepare and have approved a Historic Depiction Program (HDP) in order to protect and preserve the City's unique cultural, historical, political, architectural and economic heritage; and Whereas, on July 24, 2007, the Cultural Heritage Commission considered and approved a request to place the HDP for the new building at the existing buildings' courtyard area; and Whereas, the applicant, Dan Friess, 32302 Camino Capistrano, Suite 107, San Juan Capistrano, CA 92675, prepared and submitted a HDP dated June 24, 2008; and, Whereas, the Cultural Heritage Commission considered the Capistrano Village Center (Solana Rincon) HDP and considered public input on the proposed Application. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings with respect to the Capistrano Village Center (Solana Rincon) Historic Depiction Program: The Cultural Heritage Commission hereby finds that the Historic Depiction Program for the Capistrano Village Center (Solana Rincon) project is consistent with the intent of City Council Policy #606, and meets the adopted HDP Review Criteria. 2. The Capistrano Village Center (Solana Rincon) HDP is consistent with the goals, policies and objectives of the San Juan Capistrano General Plan's Cultural Resources Element because the HDP provides accurate, appropriate and historical information that is accessible to the general public. CHC Resolution 08-7-29-1 2 July 29, 2008 Capistrano Village Center (Solana Rincon) HDP (AC 06-13) NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby approves the Capistrano Village Center (Solana Rincon) HDP subject to the conditions in Exhibit A attached hereto and incorporated herein. Any proposed modifications to the HDP shall be submitted to the City Community Development, Department for review. For the purpose of these conditions, the term "applicant" shall also mean the developer, the owner or any successor(s) in interest to the terms of this approval. 1. The approved location for the wall -mounted granite HDP plaque is the Alternate 2 location shown by the applicant on the site -floor plan of the HDP submission, with the top of the plaque to be approximately 60" above the ground. This location is on the wall generally between- the entry doors to Suites 1 and 2 of Building A as shown on the site plan for AC 06-13. 2. The applicant shall comply with the requirements of Condition No. 2.5 of Planning Commission Resolution No. 07-07-24-01 to install the HDP per this approval or provide assurance for its installation prior to. the issuance of a Certificate of Occupancy for the new building. 3. The applicant or successors shall be responsible for perpetual maintenance of the HDP in a pristine condition for the life of the development project.
