CHC Resolution-08-06-24-01RESOLUTION NO. 08-6-24-1 ORTEGA HIGHWAY GAS STATION HISTORIC DEPICTION- PROGRAM ARCHITECTURAL CONTROL (AC) 04-03 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING THE HISTORIC DEPICTION PROGRAM FOR AC 04-03, ORTEGA HIGHWAY GAS STATION Whereas, on December 14, 2004, the City approved an application for an architectural control for 5,171 square foot gas station, minimart, self -serve car wash, take- out food service and retail with a 927 square foot mezzanine office and six two-sided dispensers under a freestanding canopy located on the north side of Ortega Highway between 1-5 and Avenida Los Cerritos and further described as Assessor's Parcel No. 650- 151-28; and Whereas, City Council Policy No. 606 requires new development projects to prepare and have approved a Historic Depiction Program (HDP) in order to protect and preserve the City's unique cultural, historical, political, architectural and economic heritage; and Whereas, the applicant, Richard Finkel, Bundy -Finkel Architects, 20331 Irvine Avenue Suite 7, Santa Ana Heights, CA 92707, prepared and submitted an HDP dated June 11, 2008; and, Whereas, on June 24, 2008, the Cultural Heritage Commission considered the Ortega Highway Gas Station HDP and considered public input on the proposed Application. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings with respect to the Ortega Highway Gas Station Historic Depiction Program: 1. The Cultural Heritage Commission hereby finds that the Historic Depiction Program for the Ortega Highway Gas Station project is consistent with the intent of City Council Policy #606, and meets the adopted HDP Review Criteria. 2. The Ortega Highway Gas Station HDP is consistent with the goals, policies and objectives of the San Juan Capistrano General Plan's Cultural Resources Element because the HDP, as conditioned, provides accurate, appropriate and historical information that is accessible to the general public. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby approves the Ortega Highway Gas Station HDP subject to the conditions in Exhibit A attached hereto and incorporated herein. Secretary RESOLUTION #: 08-6-24-1 EXHIBIT A CULTURAL HERITAGE COMMISSION CONDITIONS OF APPROVAL Project #: AC 04-03 Project Name: Ortega Highway Gas Station HDP APPROVAL DATE: June 24, 2008 EFFECTIVE DATE: July 10, 2008 EXPIRATION DATE: N/A These conditions of approval apply to the Historic Depiction Program (HDP) for the Ortega Highway Gas Station (AC 04-03). Any proposed modifications to the HDP shall be submitted to the City Community Development Department for review. For the purpose of these conditions, the term "applicant" shall also mean the developer, the owner or any successor(s) in interest to the terms of this approval. 1. The narrative text shall be modified as follows: a. To add accent marks over the "e" in "Jose" and over the "a" in "Portola." b. The text in the fourth paragraph shall be modified after the words "...future Mission..." to replace "...in this area..." with "San Juan Capistrano and Mission San Buenaventura." c. The text in the fourth paragraph shall be modified to replace "sired" with "fathered." 2. The plaque is approved to be 24" wide by 24" high. If sufficient space exists, a line giving credit to the artist may be engraved below the image. 3. The applicant shall comply with the requirements of Condition No. 2.6 of Planning Commission Resolution No. 04-12-1-1 and shall install the HDP per this approval within 60 days of the effective date of this approval. 4. The ownertapplicant or successors in interest shall be responsible for perpetual maintenance of the HDP in a pristine condition for the life of the development project.
