CHC Resolution-08-11-25-01RESOLUTION NO. 08-11-25-1 THE VILLA WEDDING VENUE HISTORIC DEPICTION PROGRAM ARCHITECTURAL CONTROL 05-03 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING THE HISTORIC DEPICTION PROGRAM FOR ARCHITECTURAL CONTROL 05-03 (THE VILLA WEDDING VENUE) Whereas, on April 11, 2006, the City approved Conditional Use Permit and Architectural Control applications, among other entitlements, for a new wedding and special events venue located at 31431 Camino Capistrano and further described as Assessor's Parcel No. 121-130-04; and Whereas, City Council Policy No. 606 requires new development projects to prepare and have approved a Historic Depiction Program (HDP) in order to protect and preserve the City's unique cultural, historical, political, architectural and economic heritage; and Whereas, the applicant, John Q. Humphreys, 31752 Los Rios Street, San Juan Capistrano, CA 92675, prepared and submitted an. HDP dated November 17, 2008; and, Whereas, the Cultural Heritage Commission considered the HDP on November 25, 2008. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings with respect to The Villa Historic Depiction Program: The Cultural Heritage Commission hereby finds that the Historic Depiction Program for The Villa project is consistent with the intent of City Council Policy #606, and meets the adopted HDP Review Criteria. 2. The Villa HDP is consistent with the goals, policies and objectives of the San Juan Capistrano General Plan's Cultural Resources Element because the HDP provides a high quality representation of appropriate information relative to San Juan Capistrano's history that is accessible to the general public. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby approves The Villa HDP subject to the conditions in Exhibit A attached hereto and incorporated herein. Draft CHC Resolution 08-11-25-1 2 November 25, 2008 The Villa HDP (AC 05-03) PASSED, APPROVED AND ADOPTED this 25th day of November,2008, by the following vote, to wit: AYES: Commissioners Porter, Tryon, Chair Nunez and Vice -Chair Banda NOES: None ABSTAIN: None ABSENT: Commissioner Teri Delcamp, Historic Preservation Manager, Commission Secretary RESOLUTION #: 08-11-25-1 EXHIBIT A CULTURAL HERITAGE COMMISSION CONDITIONS OF APPROVAL Project #: AC 05-03 Project Name: The Villa HDP APPROVAL DATE: November 25, 2008 EFFECTIVE DATE: December 11, 2008 EXPIRATION DATE: N/A These conditions of approval apply to the Historic Depiction Program (HDP) for The Villa Wedding Venue (AC 05-03). Any proposed modifications to the HDP shall be submitted to the City Community Development Department for review. For the purpose of these conditions, the term "applicant" shall also mean the developer, the owner or any successor(s) in interest to the terms of this approval. 1. The applicant shall comply with the requirements of Condition No. 16 of Planning Commission Resolution No. 06-4-11-1 to install the HDP per this approval as modified herein. 2. The cast bronze plaque shall be at least 11" X 14" or larger as necessary to accommodate all the text in a legible manner. 3. The applicant shall submit the final proof for the exterior plaque for approval of the Historic Preservation Manager prior to fabrication and prior to issuance of the Certificate of Occupancy. 4. Within 90 days after the issuance of a Certificate of Occupancy; the applicant shall call for a final inspection by the Historic Preservation Manager of the installed exterior plaque to ensure consistency with all conditions and terms of this approval. 5. The applicant or successors shall be responsible for perpetual maintenance of the HDP in a pristine condition for the life of the development project.
