CHC Resolution-07-11-13-02CHC RESOLUTION NO. 07-11-13-2 CENTRA POINTE HISTORIC DEPICTION PROGRAM ARCHITECTURAL CONTROL (AC) 06-17 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING THE HISTORIC DEPICTION PROGRAM FOR ARCHITECTURAL CONTROL (AC) 06-17 (CENTRA POINTE) Whereas, on November 6, 2006, the applicant submitted an application for an Architectural Control to permit construction of a 35,874 office complex consisting of three buildings located at the northwest corner of Rancho Viejo Road and Golf Club Drive and further described as Assessor's Parcel Nos. 650-592-01 & 02; and Whereas, City Council Policy No. 606 requires new development projects to prepare and have approved a Historic Depiction Program (HDP) in order to protect and preserve the City's unique cultural, historical, political, architectural and economic heritage; and Whereas, on October 9, 2007, the applicant, Centra Realty Corporation, prepared and submitted an HDP dated October 8, 2007; and, Whereas, the Cultural Heritage Commission held a meeting on November 13, 2007, to review the Centra Pointe HDP. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings with respect to the Centra Pointe Historic Depiction Program: The Cultural Heritage Commission hereby finds that the Historic Depiction Program for the Centra Pointe project is consistent with the intent of City Council Policy #606, and meets the adopted HDP Review Criteria. 2. The Centra Pointe HDP is consistent with the goals, policies. and objectives of the San Juan Capistrano General Plan's Cultural Resources Element because the HDP in that it is appropriate to the native American kilns located in the vicinity of the project site; explains a significant aspect of the history of the area; and is located in a area that is accessible to the future users of the offices and general public. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby approves the Centra Pointe HDP subject to the conditions in Exhibit A attached hereto and incorporated herein. Any proposed modifications to the HDP shall be submitted to the City Planning Department for review. For the purpose of these conditions, the term "applicant" shall also mean the developer, the owner or any successor(s) in interest to the terms of this approval. Prior to installation, the applicant shall submit to the Historic Preservation Manager for approval details showing the exact method of attachment of the plaque to the pedestal. In addition, the applicant shall submit samples of the pedestal finish, including material and color samples, that complement the materials and color palette for the project. In addition, the smoke shall be lightened to reveal the kiln wall more clearly and the figures shall be separated somewhat to distinguish them as two separate figures. 2. The text for the HDP shall be modified to read in its entirety as follows: EL HORNO EI Horno Street, Spanish for "The Oven," extends from here, under the 1-5 Freeway and on to EI Camino Real. The street name commemorates ovens, better known as kilns, that were once located alongside the hill above the street in the early Mission days, about the 1780s. Only one kiln, out of a possible four known, remains under the soil. Erosion of the hill and subsequent homes built into the hillside cover remnants. of the ovens. Several years ago the City bought the lot behind a home on which the one known kiln is located, preserved the kiln and covered it with soil to protect it from the elements. The kiln extends ten feet below the soil and is approximately 12 feet in diameter. It may have exceeded 20 feet in height but its dome was destroyed long ago. It is believed to be the largest kiln in California. Access to it is through a privately owned residential lot. The Franciscan padres taught the Native American Juanenos of the Acjachemen Nation how to build these kilns to fire the roof and floor tiles for construction of the Mission buildings. The ovens were also used to produce lime for brick mortar and plaster to cover the Mission adobe walls. The applicant shall comply with the requirements, conditions and mitigation measures as approved by the Planning Commission and the HDP shall be installed, and approved by the Historic Preservation Manager, prior to the issuance of a Certificate of Occupancy. 4. The applicant or successors shall be responsible for perpetual maintenance of the HDP in a pristine condition for the life of the development project.
