A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN
JUAN CAPISTRANO APPROVING A REVISED HISTORIC DEPICTION PROGRAM FOR
ARCHITECTURAL CONTROL (AC) 03-09 (MAMMOTH PROFESSIONAL BUILDINGS)
Whereas, on May 11, 2004, the City approved an application for the
development of two professional office buildings consisting of approximately 98,000 square
feet and associated site improvements located at the north end of town on Rancho Viejo
Road just south of Via Escolar and further described as Assessor's Parcel No. 650-011-32;
and
Whereas, City Council Policy No. 606 requires new development projects to
prepare and have approved a Historic Depiction Program (HDP) in order to protect and
preserve the City's unique cultural, historical, political, architectural and economic heritage;
and
Whereas, on June 22, 2004, and January 25, 2005, the Cultural Heritage
Commission (CHC) approved a Historic Depiction Program for the Mammoth project,
consisting of framed, captioned photographs and a map in each building lobby depicting
the aviation history of San Juan Capistrano; and
Whereas, on May 25, 2006, the applicant requested input from the CHC
regarding a potential change of the HDP to a paleontological theme. The CHC indicated
that the concept may be acceptable, subject to the provision of information on recorded
fossil discoveries in San Juan Capistrano to support the HDP and connect it to San Juan
Capistrano's pre -history. In addition, the CHC indicated that the approved aviation HDP
needs to be proposed for a future development project so it is not lost; and
Whereas, the applicant, Kent Ahlering, Mammoth Equities Construction
Group, 20532 EI Toro Road, Suite #302, Mission Viejo, CA 92692, prepared and submitted
a revised HDP with a paleontological theme on October 12, 2006; and,
Whereas, the Cultural Heritage Commission conducted a public meeting on
Tuesday, October 24, 2006, pursuant to Section 9-2.313 of the Municipal Code to review
the Mammoth Professional Buildings revised HDP and consider public input on the
proposed Application.
NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage
Commission of the City of San Juan Capistrano does hereby make the following findings
with respect to the Mammoth Professional Buildings revised Historic Depiction Program:

Mammoth Professional Buildings Revised HDP (AC 03-09)
The Cultural Heritage Commission hereby finds that the revised Historic Depiction
Program for the Mammoth Professional Buildings project, as conditioned, is
consistent with the intent of City Council Policy #606, and meets the adopted HDP
Review Criteria.
2. The Mammoth Professional Buildings revised HDP, as conditioned, is consistent
with the goals, policies and objectives of the San Juan Capistrano General Plan's
Cultural Resources Element because the revised HDP provides accurate,
appropriate pre -historic information in a high quality design that is accessible to the
general public regarding an under -represented period of San Juan Capistrano's
history.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural
Heritage Commission of the City of San Juan Capistrano hereby approves the Mammoth
Professional Buildings revised HDP subject to the conditions in Exhibit A attached hereto
and incorporated herein.
PASSED, APPROVED AND ADOPTED this 24th day of October, 2006, by
the following vote, to wit:

These conditions of approval apply to the revised Historic Depiction Program (HDP) for
Mammoth Professional Buildings (AC 03-09). Any proposed modifications to the HDP shall
be submitted to the City Planning Department for review. For the purpose of these
conditions, the term "applicant" shall also mean the developer, the owner or any
successor(s) in interest to the terms of this approval.
1. The narrative panels shall be revised, per the corrections noted on the
exhibits by the Historic Preservation Manager dated October 17, 2006, as
modified by the CHC per this approval. Said corrections, and the following
modifications, shall be completed prior to fabrication and installation:
a. The overview panels in each display, titled "The Pleistocene Climate",
shall be revised to replace the second incomplete paragraph with the
following text:
"In the region around San Juan Capistrano, the increase in precipitation
during the Ice Age provided lush grassy savannas and woodlands in
which a large variety of animals lived. Sixty mammal species lived in the
area during the Pleistocene, including Columbian mammoths, mastodons,
dire wolves, saber-toothed cats, bears, antelope, giant bison, camels,
horses, sloths, coyotes and numerous small mammals. These animals as
well as reptiles, amphibians and birds were abundant in the drainage
channels, watering holes, meadows and grasslands of the Capistrano
Valley region. The exhibits in this display depict some of the fossils that
have been discovered in San Juan Capistrano and the surrounding area."
b. All of the fossil panels shall be revised to incorporate information from the
paleontological records searches, identifying the locations of local
discoveries for each fossil species.
c. The overview panel in each display shall delete the marine fossil images,
and incorporate a vicinity map highlighting the paleontological area
boundary.
d. The overall size of the display shall be enlarged by 50%, with a
proportional increase in size of each of the panels, and text within, to
ensure legibility.

2. The applicant shall install the project HDP prior to the issuance of a
Certificate of Occupancy. In the event the revised HDP displays per this
approval are not completed by that time, the originally approved HDP shall
be installed temporarily prior to issuance of a Certificate of Occupancy. The
applicant shall then work to complete the revised HDP in a timely manner
and install said HDP per this approval.
3. The applicant or designee shall be responsible for perpetual maintenance of
the HDP in a pristine condition for the life of the development project.
