CENTER HISTORIC DEPICTION PROGRAM A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO APPROVING THE HISTORICDEPICTION PROGRAM FOR ARCHITECTURAL CONROL 02-01(ORTEGA ANIMAL CARE. CENTER, FORMERLY ORTEGA ANIMAL HOSPITAL) Whereas, on September 10, 2002, the City approved an application for a new, two-story 7,767 square foot Veterinary hospital/commercial kennel located at 27341 Ortega. Highway and further described as Assessor's Parcel No. 650-201-15; and, Whereas, City Council Policy No. 606 requires new development projects to prepare and have approved a Historic Depiction Program (HDP) in order to protect, and preserve the City's unique cultural, historical, political, architectural and economic heritage; and, Whereas, the applicant, Dr. James Rich, P.O. Box 19097, Irvine, CA 92623 prepared and submitted an HDP dated March 10, 2006; and, Whereas, the Cultural Heritage Commission conducted a public meeting on Tuesday, March 28, 2006, pursuant to Section 9-2.313 of the Municipal Code to review the Ortega Animal Care, Center HDP and consider public testimony on the proposed Application. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings with respect to the Ortega Animal Care Center Historic Depiction Program: 1. The Cultural Heritage Commission hereby finds that the Historic Depiction Program for the Ortega Animal Care Center project is consistent with the intent of City Council Policy #606, and meets the adopted HDP Review Criteria. 2. The Ortega Animal Care Center HDP is consistent with the goals, policies and objectives of the San Juan Capistrano General Plan's Cultural Resources Element because the HDP provides accurate, -appropriate and historical information that is accessible to the general public. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San- Juan- Capistrano hereby approves the Ortega Animal Care Center HDP subject to the conditions in Exhibit A attached hereto and incorporated herein. CHC Resolution 06-03-28-1 2 March 28, 2006 Ortega Animal Care Center HDP (AC 02-01) PASSED, APPROVED AND ADOPTED this 28th day of March, 2006, by the following vote, to wit: AYES: Commissioners Belardes, Nunez, Siegel, Tryon and Chair Porter NOES: None ABSTAIN: None ABSENT: Commissioner Andrews and Vice -Chair Forster Lorie Porter, Chair Teri Delcamp, Historic Preservation Manager, Commission Secretary CHC RESOLUTION NO. 06-03-28-1 EXHIBIT A CULTURAL HERITAGE COMMISSION CONDITIONS OF APPROVAL Project #: AC 02-01 Project Name: Ortega Animal Care Center HDP APPROVAL DATE: March 28, 2006 EFFECTIVE DATE: April 12, 2006 EXPIRATION DATE: N/A These conditions of approval apply to the Historic Depiction Program (HDP) for the Ortega Animal Care Center (AC 02-01). Any proposed modifications to the HDP shall .be submitted to the City PlanningDepartment for review. For the purpose of these conditions, the term "applicant shall also mean the developer, the owner or any successor(s) in. interest to the terms of this approval. 1. The narrative text shall be revised to read in its entirety as follows: "GASPAR de PORTOLA In 1769, Spain decided that its Alta California Territory needed to be explored and .colonized. Spain was concerned about incursions by England and Russia along these shores. The Viceroy of Mexico appointed Gaspar de Portola as Governor of the Californias and Commander of a military expedition.to explore Alta California and locate the Bay of Monterey in order to establish a future settlement there. He also directed Frey Junipero Serra and several other padres to join the expedition in order to note potential Mission sites with the intent to convert the natives to Christianity. Frey Serra stayed behind in San Diego and sent two of his padres, Fr. Juan Crespi and Fr. Francisco Gomez; to accompany Portola, to explore the way and acquaint themselves with the natives. About four miles to the east of this spot, Portola and his expedition crossed the San Juan Creek and what someday would be the Ortega Highway and encamped under the oaks. There, he sent Sergeant Jose Francisco de Ortega, his scout, ahead to search this area for the safest route northward and assess the native population. It is believed that Ortega was the first European to view the Capistrano Valley where eventually the Mission San Juan Capistrano would be established. From here Portola led his party all the. way to San Francisco Bay."
