CHC Resolution-04-10-26-01RESOLUTION NO. 04-10-26-1 BRAVO BURGER HISTORIC DEPICTION PROGRAM ARCHITECTURAL CONTROL (AC) 99-03 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE ClNOF SAN JUAN CAPISTRANO APPROVING THE HISTORIC DEPICTION PROGRAM FOR ARCHITECTURAL CONTROL (AC) 99-03 (BRAVO BURGER). Whereas, on June 23rd, 1999, the City approved an application for an Architectural Control for an approximately 2350 square foot restaurant building generally located on the east side of Rancho Viejo Road, approximately 600 feet southeast of the corner of Ortega Highway and Rancho Viejo Road at 31722 Rancho Viejo Road, and further described as Assessor’s Parcel No. 666-261 -08; and Whereas, City Council Policy No. 606 requires new development projects to prepare and have approved a Historic Depiction Program (HDP) in order to protect and preserve the City’s unique cultural, historical, political, architectural and economic heritage; and Whereas, the applicant, Harry Christy of Bravo Burgers, Inc., prepared and submitted an HDP dated September 1,2004; and, L Whereas, the Cultural Heritage Commission conducted a public meeting on Tuesday, October 26, 2004 pursuant to Section 9-2.313 of the Municipal Code to review the Bravo Burger HDP and consider public testimony on the proposed Application. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings with respect to the Bravo Burger Historic Depiction Program: 1. The Cultural Heritage Commission hereby finds that the Historic Depiction Program for the Bravo Burger project is consistent with the intent of City Council Policy No 606, and meets the HDP Review Criteria. 2. The Bravo Burger HDP is consistent with the goals, policies and objectives of the San Juan Capistrano General Plan’s Archaeologic & Historic Element because the HDP provides for enhancement of the historically significant Ortega Highway corridor and provides accurate, appropriate and historical information that is accessible to the general public. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano hereby approves the Bravo Burger HDP subject to the following condition: CHC Resolution 04-10-26-1 -2- October 26,2004 L.- Bravo Burger HDP 1. The applicant shall modify the wording of the plaque to read as follows: THE HISTORY OF ORTEGA HIGHWAY The route of Ortega Highway follows a Native American trail leading from the Capistrano Valley to San Juan Hot Springs (Agua Caliente) located approximately 13 miles east of here. The original dirt foot path served as a trading route following the edge of San Juan Creek from the valley tribal village areas and over the Santa Ana mountains. The Acjachemen Indians traded regularly with the inland tribes. The path was explored by Sergeant Jose Francisco Ortega in 1769, for whom it was later named. The Acjachemen Indians showed Franciscan Missionaries the hot springs after the founding of the San Juan Capistrano Mission in 1776. The road eventually became known as Hot Springs Road and was widely used by padres and visitors to the therapeutic waters of the hot springs. At the height of the Great Depression, Highway 74 was constructed and completed along this route in 1933 and was used for transporting harvested crops from the railroad for distribution. Thousands use this majestic route daily.
