CHC Resolution-04-06-07-01CHC RESOLUTION NO. 04-06-07-1 ARCHITECTURAL CONTROL (AC) 02-07 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO RECOMMENDING APPROVAL OF ARCHITECTURAL CONTROL (AC) 02-07 APPLICATION FOR THE DEVELOPMENT OF RECREATIONAL AND ATHLETIC FACILITIES ON APPROXIMATELY 29.2 ACRES OF LAND LOCATED AT THE SOUTHEAST CORNER OF CAMINO CAPISTRANO AND JUNIPER0 SERRA ROAD AND MORE SOUTH CAMPUS). PRECISELY REFERRED TO AS APN 649-01 1-25,649-011-30 (J.SERRA HIGH SCHOOL - Whereas, Pueblo Serra Inc. requests approval of entitlements for an existing 29.2 acre site located along the southeast corner of Junipero Serra Road and Camino Capistrano to develop athletic and recreational facilities including: performing arts complex; gymnasium; aquatic center; baseball; soccer and baseball fields; volleyball, basketball, and tennis courts; footballltrack field; parking; a historic depiction honoring the Native American culture; and a pedestrian footbridge and plaza linking the South Campus with the North Campus located on the northeast corner of Junipero Serra Road and Camino Capistrano; and, Whereas, the property is General Plan-designated “P&l” (Public & Institutional), and the zoning designation for the site is also “PBI” (Public & Institutional); and Whereas, the Environmental Administrator has required preparation of an environmental impact report pursuant to Section 15081 of those Guidelines; has issued the Notice of Preparation (NOP) pursuant to Section 15082 of those guidelines, has overseen the preparation of the Draft Environmental Impact Report (DEIR) prepared pursuant to Section 15084 of those Guidelines, has issued a Notice of Completion pursuant to Section 15085 of those Guidelines, and has otherwise complied with all applicable provisions of the California Environmental Quality Act (CEQA); and all mitigation measures will be included in the final approving resolution as conditions of approval; and, Whereas, the Cultural Heritage Commission conducted a duly-noticed public meeting on Tuesday, May 25, 2004, and Monday, June 7, 2004 pursuant to the provisions of Administrative Policy409, and Planning Department Policy 51 0 to consider public testimony on the proposed project and has considered all relevant public comment, the DEIR, the proposed Historic Depiction Program (HDP), and written and oral staff reports. NOW, THEREFORE, BE IT RESOLVED, that the Cultural Heritage Commission of the City of San Juan Capistrano does hereby make the following findings: 1. The proposed project will be consistent with the General Plan Cultural Resources Element Cultural Resources Goal 1 which states that the City will “preserve and protect historical, archaeological, and paleontological resources. ” 2. The proposed project will be consistent with the General Plan Cultural Resources Element which states that the City will “balance the benefits of development with the project’s potential impacts to existing cultural resources. ” CHC Resolution 04-06-07-1 2 June 7,2004 3. The proposed project will be consistent with the General Plan Cultural Resources Element which states the City will “identify, designate, and protect buildings and sites of historic importance.” 4. The proposed HDP meets the requirements of City Council Policy 606. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission hereby recommends as follows: I. That the Planning Commission adopt a statement of overriding considerations finding that the benefits of the project outweigh the significant unavoidable impacts to cultural resources identified by the Environmental Impact Report (EIR) and certify that the EIR was prepared in accordance with CEQA and adequately reflects the project impacts and appropriate mitigation measures; and ii that the Planning Commission approve the project subject to the mitigation measures for Cultural Resources as specified in the final EIR as modified with the addition of the following mitigation measure: “The site plan shall provide accommodation for an area of approximately 100 sq. ft. adjacent to the sidewalkhrail for historic monumentation to provide public information about the cultural and historical aspects of the site. Said area shall be dedicated to the City as part of the public right-of-way. Final design and location of the monumentation area shall be subject to review and approval by the Cultural Heritage Commission.
