CHC Resolution-02-11-26-01CHC RESOLUTION 02-1 1-26-1 A RESOLUTION OF THE CULTURAL HERITAGE COMMISSION OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, RECOMMENDING APPROVAL OF CONDITIONAL USE PERMIT (CUP) 02-12, SITE PLAN REVIEW (SPR) 02-01, and 9 AND TO SECTION 3.B.6.C.6 OF THE LOS RlOS SPECIFIC PLAN TO RELOCATE AN EXISTING SDG&E CARETAKER RESIDENCE TO AN EXISTING 0.76 ACRE LOT FOR USE AS A “SECONDARY DWELLING UNIT” LOCATED AT AND EXCEPTIONS TO SECTIONS 9-3.607(C)(6) AND 9-3.602(G)(2)(1) OF TITLE 26621 RAMOS STREET; A.P.N. 121 -142-12 (DAVIDSON PROPERTY) WHEREAS, David and Maryann Davidson have requested approval of site and architectural plans to relocate an existing SDG&E “troubleman’s cottage” (unit ##4) to their property located at 26621 Ramos Street, and a conditional use permit to use the structure as a “secondary dwelling unit,” and requests approval of an exception to Section 9-3.607(~)(6) which establishes a maximum 1,000 square feet for a secondary dwelling unit; an exception to Section 9-3.602(9)(2)( I) which requires single-family detached residences provide “two (2) off-street parking spaces per dwelling unit in a garage, ” and an exception to Section 3.B.6.c.6 of the Los Rios Specific Plan to allow a structure with a maximum height of 22’-0” where the “LDR” (Low Density Residential) District establishes a maximum of 18’-0”; and, WHEREAS, the Environmental Administrator has reviewed the project pursuant to Section 15061 of the California Environmental Quality Act (CEQA) and determined that the project is categorically exempt because Section 15303 of the California Environmental Quality Act Guidelines establishes the Class 3 exemption for “New Construction or Conversion of Small Structures” which expressly exempts “One single- family residence, or a second dwelling unit in a residential zone. In urbanized areas, up to three single-family residences may be ConStr~Ct8d or converted under this exemption. ’I The City has posted the Notice of Exemption and otherwise complied with all applicable provisions of California Environmental Quality Act; and, I WHEREAS, on November 26, 2002, the Cultural Heritage Commission conducted a duly noticed public meeting to receive testimony on the proposed project. NOW, THEREFORE BE IT RESOLVED, that the Cultural Heritage Commission does hereby find as follows: 1. The proposed project would be consistent with the Los Rios Specific Plan’s “LDR” (Low Density Residential) District Regulations because the use is consistent with the use provisions applicable to the District and the project meets all applicable development standards subject to approval of a height exception to allow a 22’-0’’ building height where the Los Rios Specific Plan establishes a maximum height of 18’-0”; and, CHC Resolution 02-1 1-26-1 2 November 26,2002 2. The project is consistent with Los Rios Specific Plan’s Architectural Design Guidelines and Site Design Standards because the Plan allows structures to be relocated to or from the Los Rios Specific Plan District, outside the Los Rios National Register Historic District subject to certain criteria and the proposed structure complies with those criteria as follows: a. The relocated caretaker residence is historically and architecturally significant as evidenced by listing on the City’s Inventory of Historic & Cultural Landmarks (IHCL) subject to the conditions of approval contained herein. b. The relocated caretaker residence is architecturally compatible with the District based on building mass and architectural style, recognizing that California adobe, Victorian, and vernacular board & batten structures are common styles characteristic of the District. c. The relocated caretaker residence complies with all development standards of the “LDR” (Low Density Residential) District subject to approval of the requested building height exception. 3. The project is consistent with the standards of Title 9, Section 9-3.607(c), secondary dwelling units subject to the conditions of approval contained herein; and, BE IT FURTHER RESOLVED, that the Cultural Heritage Commission hereby recommends approval of the proposed project subject to the following: 1. 2. 3. 4. Prior to issuance of any building permit, the Planning Director shall determine that the building permit site and exterior architectural plans substantially comply with the Planning Commission-approved site and exterior architectural plans. Prior to issuance of any occupancy certificate, the property owner will have secured City Council approval of listing of the structure on the City’ Inventory of Historical and Cultural Landmarks. Prior to issuance of any building permit for the proposed detached, two-car garage, decks and trellis, or fencing, the project will have submitted preliminary plans and a materials & color board for review and approval by the Design Review Committee. However, the Planning Director may administra-tively approve the deck-trellis and fencing plans pursuant to the provisions of the Los Rios Specific Plan. In the event the Planning Director determines the deck-trellis plans or fencing plans are in any material way, inconsistent with the design guidelines, the Director shall refer said plans to the Design Review Committee for review and recommendation. The Conditional Use Permit for the Secondary dwelling units shall be in full force and remain effective fore a period of five (5) years from the date of final approval CHC Resolution 02-1 1-26-1 3 November 26,2002 and shall expire on November 26,2007. Prior to that date, the property owner will have secured City Council approval of a parcel map establishing a separate legal parcel and will have recorded the parcel map with the County Recorder thereby establishing the cottage as a principal dwelling. 5. Prior to November 26,2005, the project will have secured approval of architectural plans, secured necessary building and grading permits, completed all construction and been granted final occupancy permits by the City for the detached, two-car garage. 6. Prior to issuance of any grading permit, the project will submit an erosion control and drainage plan which shall be subject to review and approval by the city Engineer for compliance with applicable National Pollution Discharge Elimination Program standards and best management practices (BMP) including the following: a. Site drainage including roof drains from the proposed residence and garage shall be designed to direct drainage to the natural swale which bisects the property. b. The proposed driveway and walkways will be designed and constructed with an impervious or semi-pervious surface including pervious concrete, inter- locking pavers, or similar material subject to the approval of the City Engineer to determine compliance with water quality and drainage standards and the Planning Director to determine compliance with the Los Rios Specific Plan’s design standards.
