17-0302_ED ALMANZA & ASSOCIATES_Project Initiation Memo 2/27/2017 Proiect Initiation Memo TO: Ben Siegel, City Manager FROM: Steve May, Public Works and Utilities Director.4 Prepared by: Mike Marquis, P.E., Associate Civil Engineer SUBJECT: First Amendment to Professional Services Agreement with Ed Almanza & Associates for preparation of Riding Park Environmental Documents. Description: The purpose of this Amendment is to correct typographical errors in the original Agreement, as further described below. In July of 2017, staff solicited bids from four qualified firms to provide environmental services (CEQA) for utility improvements at the Rancho Mission Viejo Riding Park at San Juan Capistrano. Staff received two bids that were responsive to the City's needs, and recommended award to Ed Almanza&Associates(EAA),the low bidder. On August 30,2016,the City Manager approved a professional services agreement with EAA in the amount not to exceed $27,480. EAA prepared the CEQA document(Initial Study/Mitigated Negative Declaration), posted the Notice of Intent with the County Clerk on January 12, 2017, and distributed the document to the required recipients. The public review period was 30 days as required by law. It was recently discovered that there are typographical errors in the Professional Services Agreement that require correction at this time. The agreement was issued to"Ed Almanza&Associates,a Company",which is not correct. The correct terminology is"Ed Almanza(doing business as Ed Almanza & Associates), a Sole Proprietorship". Staff worked with legal counsel to correct this oversight through Amendment 1 to the Agreement, which is attached for consideration. Upon execution of the Amendment, staff will also issue a revised Purchase Order to reference the correct business name terminology. Location: Southwest corner of Ortega Highway and La Pata Boulevard. Project Cost: The project cost is unchanged by the amendment. Funding Source: 50-93799-62281-17201-002 (PO 524747) Proposals: Competitive Proposals Proposals: The amendment does not require competitive proposals. Staff Analysis & Recommendation: Staff recommends that the City Manager approve Amendment 1 to the Professional Services Agreement with Ed Almanza for Environmental Services associated with the Utility Project at the Rancho Mission Viejo Riding Park.
