Resolution Number 17-03-21-03RESOLUTION NO. 17-03-21-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA APPROVING THE DEL OBISPO STREET WIDENING PROJECT (CIP16102) WHEREAS, the City's Capital Improvement Program represents an important mechanism for implementing the goals, policies, and recommendations of the General Plan, in particular the circulation, safety, parks and recreation, and growth management policies; and, WHEREAS, the City has established an administrative policy for developing a Capital Improvement Program, and the Capital Improvement Program Committee developed a draft Fiscal Year (FY) 2016-2023 Capital Improvement Program pursuant to the City's Capital Improvement Guidelines; and, WHEREAS, among other things, one of the major capital improvement projects in the draft FY 2016-2023 Capital Improvement Program included the Del Obispo Street Widening Project (CIP16102); and, WHEREAS, the Del Obispo Street Widening Project (CIP16102) includes the widening of a portion of Del Obispo Street between Calle Aspero to Paseo de La Paz. Among other things, the project includes two through lanes in each direction, where in some sections there is only one, new sidewalk on the west side of the street, new bike lanes in both directions, new street lights, and the removal of up to six (6) trees on the northwest side of Del Obispo Street ("Project"); and, WHEREAS, on June 21, 2016, the City Council approved the FY 2016-2023 Capital Improvement Program, including the Project; and, WHEREAS, an Initial Study and Notice of Intent to adopt a Mitigated Negative Declaration for the Project were prepared in accordance with State CEQA Guidelines section 15071, commencing the environmental review process and preparation of a Mitigated Negative Declaration; and, WHEREAS, a Notice of Intent to adopt a Mitigated Negative Declaration for the Project was filed and a copy was circulated between November 28, 2016 through January 9, 2017; and, WHEREAS, the Mitigated Negative Declaration analyzed the impacts related to the Project as a whole; and, WHEREAS, the Design Review Committee (DRC) reviewed the Project on November 10, 2016, and December 8, 2016, for review and approval of the retaining wall design along the west side of Del Obispo Street. The DRC reviewed and recommended approval of Verdura-type retaining walls; and, 3/21/2017 WHEREAS, the Planning Commission conducted a duly -noticed public meeting on February 14, 2017, pursuant to Title 9, Land Use Code, Section 9-2.302(g), to consider the proposed Project, including the Mitigated Negative Declaration for the Project, and considered all relevant public comments; and, WHEREAS, the Planning Commission, after carefully considering all pertinent testimony and the staff report offered in the case as presented at the public meeting, recommended that the City Council adopt the Mitigated Negative Declaration and approve the Project; and, WHEREAS, the City Council conducted a duly -noticed public meeting on March 21, 2017, pursuant to Title 9, Land Use Code, Section 9-2.302(g), to consider the proposed Project, including the Mitigated Negative Declaration for the Project, and considered all relevant public comments; and, WHEREAS, the City Council, after carefully considering all pertinent testimony and the staff report offered in the case as presented at the public meeting, adopted a Mitigated Negative Declaration for the Project and approved the associated Mitigation Monitoring and Reporting Program; and WHEREAS, the City Council, after carefully considering all pertinent testimony and the staff report offered in the case as presented at the public meeting desires to approve the Project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Juan Capistrano as follows: Section 1. Recitals. The City Council hereby finds that the foregoing recitals are true and correct and are incorporated herein as substantive findings of this Resolution. Section 2. Fundings. The City Council of the City of San Juan Capistrano does hereby make the following findings as established by Section 9-2.337(d) of Title 9, Land Use Code of the City of San Juan Capistrano in support of the Project: 1. The proposed Project is consistent with the goals, policies and objectives of the General Plan, including the Circulation Element, because the goals and policies of the General Plan Circulation Element are substantially implemented through the Project. For example, the Project is consistent with the following policies and objectives of the Circulation Element: Circulation Goal 1: Provide a system of roadways that meets the needs of the community. 2 3/21/2017 Policy 1.4: "Improve the San Juan Capistrano circulation system roadways in concert with land development to ensure sufficient levels of service." The proposed Project includes two through lanes in each direction, where in some sections there is only one. The proposed Project also includes new street lights. These roadway improvements will bring Del Obispo Street to its designated width and eliminate the current traffic "bottle -neck" situation from Calle Aspero to Paseo de La Paz. Moreover, the proposed Project will ensure sufficient levels of service, especially as land is developed in this area (e.g., the Oliva Development). Circulation Goal 3: Provide an extensive public bicycle, pedestrian, and equestrian trails network. Policy 3.1: "Provide and maintain an extensive trails network that supports bicycles, pedestrians, and horses and is coordinated with those networks of adjacent jurisdictions". Circulation Goal 4. Minimize the conflict between the automobile, commercial vehicles, pedestrians, horses, and bicycles. Policy 4.1: "Provide sufficient right-of-way widths along roadways to incorporate features that buffer pedestrians, horses, and bicycles from vehicular traffic. Policy 4.3: "Install additional street improvements within areas where necessary to improve vehicular and non -vehicular safety." The proposed Project incorporates includes new sidewalk on the west side of the street and new bike lanes in both directions. These improvements will minimize the conflict between motorists and bicyclists and buffer pedestrians and bicyclists from vehicular traffic. 2. The proposed Project complies with all applicable provisions of Title 9 of the San Juan Capistrano Municipal Code ("SJCMC" or "Code") and any applicable specific plan or comprehensive development plan because the proposed Project is a major capital improvement project, per SJCMC section 9-2.337. Specifically, the proposed Project is a street improvement that involves substantial expansion of right-of-way. The proposed Project complies with Section 9-2.337 because, among other things, the Project has undergone required environmental review, the Design Review Committee has reviewed the Project, the Project has been noticed in accordance with the Code, and the Planning Commission has reviewed the Project in compliance with the Code. 3. The proposed Project is consistent with the surrounding community and Design Guidelines because the Project complies with the following Design Issue/Principle 6: Richness of Details and Materials, which provides, "Building materials... should be 3/21/2017 high quality. They should be designed and executed with a high degree of craftsmanship. Design features should be subtle, not ostentatious. High quality design standards should apply to all private as well as public projects...." Here, the proposed Project went before the Design Review Committee, which recommended the use of Verdura-type retaining walls. That recommendation was implemented into the proposed Project. Moreover, the proposed Project complies with General Design Issue/Principle 8: Linkages and Connections, which provides, "Site planning should maximize linkages and connections to surrounding public uses, activities, and pedestrian networks. Consideration should be given to creation of a hierarchy of pedestrian pathways and public spaces." Here, the proposed Project includes new sidewalk on the west side of the street and new bike lanes in both directions, which enhances pedestrian access in the area. Section 3. Apg_r_oval of Proiect. The City Council of the City of San Juan Capistrano hereby approves the Del Obispo Street Widening Project (CIP16102). Section 4. Custodian of Records. The documents and materials associated with this Resolution that constitute the record of proceedings on which these findings are based are located at San Juan Capistrano City Hall, 32400 Paseo Adelanto, San Juan Capistrano, California 92675. The City Clerk is the custodian of the record of proceedings. Section 5. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the Resolution which can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The City Council hereby declares that it would have adopted this Resolution irrespective of the invalidity of any particular portion thereof. Section 6. Effective Date.
