(CIP 15304) RECOMMENDATION : By motion, 1. Adopt a Resolution declaring the work to be completed pursuant to the plans and specifications for the Camino Capistrano Athletic Arena Court Resurfacing Project, by Taylor Tennis Courts, Inc. (CIP 15304); and, 2. Direct the City Clerk to process recording of a Notice of Completion for the project; and, 3. Authorize staff to release the project retention in the amount of $2,499.75 thirty- five days after recordation of the Notice of Completion. EXECUTIVE SUMMARY: Construction work has been completed for the Camino Capistrano Athletic Arena Court Resurfacing Project (Location Map Attachment 1 ). The work was completed to the satisfaction of the Public Works and Utilities Director and is ready for acceptance and recordation of a Notice of Completion. On April 19, 2016, the City Council awarded a construction contract to Taylor Tennis Courts, Inc. in the amount of $48,970. One contract change order was issued during construction in the amount of $1,025. Construction was completed on July 7, 2016, with the final construction cost being $49,995. Staff recommends that the City Council adopt a resolution declaring the work completed as to plans and specifications (Attachment 2), and direct staff to record the Notice of Completion (Attachment 3) and release the retention in the amount of $2,499.75 thirty-five days after the Notice of Completion is recorded . City Council Agenda Report September 20, 2016 Page 2 of 3 DISCUSSION/ANALYSIS : The project scope included resurfacing of the tennis and basketball courts, removal of the existing carpet and padding at the soccer court, and repairing the concrete surface and applying two coats of acrylic material in lieu of installing new carpet and padding. The Project scope also included installation of windscreens at the tennis courts. The Public Works and Utilities Director accepted the work as complete pursuant to the plans and specifications for the Project on July 7, 2016. Once the Notice of Completion is recorded, a one year warranty period for the project will commence. The one year warranty will cover any construction deficiencies that might become evident. If there are no defects or warranty issues during this one year period, then staff will recommend that the City Clerk release the Construction Performance and Materials Bonds. FISCAL IMPACT: The total approved construction budget, which includes a 25% contingency, was $61 ,212. The final construction cost, including one contract change order, was $49,995. The remaining balance of $11,217 will be returned to the Facilities Operations Fund balance. ENVIRONMENTAL IMPACT: This construction project was reviewed in accordance with the California Environmental Quality Act, and It was been determined that the Project is categorically exempt from environmental review pursuant to CEQA Guidelines Section 15301 (Class 1 ). However, this action of declaring the project to be complete is not subject to the California Environmental Quality Act ("CEQA") pursuant to Section 15060(c)(3) of CEQA Guidelines because the activity is not a project as defined in Section 15378 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, and the action has no potential for resulting in physical change to the environment, directly or indirectly. PRIOR CITY COUNCIL REVIEW: • On April 19, 2016, the City Council Awarded a Construction Contract for the Camino Capistrano Sports Court Resurfacing Project to the lowest responsive bidder, Taylor Tennis Courts, Inc., in the amount of $48,970. COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS: • On November 16, 2015, the Project was presented to the Parks, Recreation, Senior, and Youth Services Commission. • On March 21, 2016, a project update was presented to the Parks, Recreation, Senior, and Youth Services Commission.
