Consideration of Approval of Change Order No. 1 for the Traffic
Signal Construction Project at Rancho Viejo Road and Paseo
Espada and Appropriation of Funds (CIP 15101) (International Line
Builders, Inc.)
RECOMMENDATION:
By motion,
1. Approve and authorize the City Manager to execute Change Order No. 1 in the
amount of $98,650 to install electrical conduit by trenching for the traffic signal
installation at Rancho Viejo Road and Paseo Espada; and,
2. Approve an appropriation of $80,680 from the Capistrano Circulation Fee
Program to increase the budget for CIP 15101 from $378,970 to $459,650 with
International Line Builders, Inc .
EXECUTIVE SUMMARY:
The Traffic Signal Construction Project at Rancho Viejo Road and Paseo Espada
includes the installation of approximately 1 ,200 lineal feet of underground electrical
conduit. During construction, the conduit installation component of the project
encountered difficulty due to unforeseen soil conditions in the area created by many
large rocks beneath the pavement. As a result, rather than directional drilling for the
conduit installation as planned by the contractor, it is necessary to open cut and re-pave

trenches in order to complete the work. The cost increase for open cut and repaving the
trench is $98,650. Since this amount exceeds the City Manager's signing authority, City
Council approval is required for Change Order No. 1 (Attachment 1 ). Pending City
Council approval of the change order, the traffic signal is expected to be operational in
early December 2016.
FISCAL IMPACT :
On April 19, 2016, the City Council awarded a Construction Contract to International
Line Builders, Inc. in the amount of $289,000 plus a 10% contingency for the
construction of a traffic signal at Rancho Viejo Road and Paseo Espada (CIP 15101 ).

ENVIRONMENTAL REVIEW
The project was previously determined to be categorically exempt under provisions of
California Environmental Quality Act (CEQA) Guidelines, Section 15061 (b )(3). The
recommended action to approve a change order is not subject to CEQA pursuant to
section 15060(c)(3) of CEQA Guidelines because the action is not a project as defined
in Section 15378 of the CEQA Guidelines, California Code of Regulations, Title 14,
Chapter 3, and the action has no potential for resulting in physical change to the
environment, directly or indirectly.
PRIOR CITY COUNCIL REVIEW:
• On April 7, 2015, the City Council directed staff to bring back for further
consideration the installation of a marked crosswalk at the intersection of Rancho
Viejo Road and Paseo Espada.

• On April 21, 2015, the City Council approved the installation of a new Traffic
Signal, pedestrian crosswalk and ADA ramps at Ranch Viejo Road and Paseo
Espada.
• On February 16, 2016, the City Council rejected the bid and authorized staff to
re-advertise and receive construction bids.
• On April 19, 2016, the City Council awarded a contract for the construction of a
Traffic Signal at Rancho Viejo Road and Paseo Espada to International Line
Builders for $289,000.

This Change Order covers changes to the subject contract as described herein. The Contractor
shall construct, furnish equipment and materials, and perform all work as necessary or required
to complete the Change Order items for a lump sum price agreed upon between the Contractor
and City of San Juan Capistrano, otherwise referred to as Owner.

The amount of the contract will be increased by the sum of $ 98,650 .00 and the contract time
shall be extended by forty (40) calendar days or the calendar days between the submittal of the
change order request by the contractor and the change order approval date by the City, whichever is
greater. The undersigned Contractor approves the foregoing Change Order #1 as to the changes, if
any, in the contract price specified for each item including any and all supervision costs and other
miscellaneous costs relating to the change in work, and as to the extension of time allowed, if any, for
completion of the entire work on account of said Change Order #1. The Contractor agrees to furnish
all labor and materials and perform all other necessary work, inclusive of the directly or indirectly
related to the approved time extension , required to complete the Change order items. This document
will become a supplement of the contract and all provisions will apply hereto. It is understood that the
Change Order shall be effective when approved by the Owner.
Contractor accepts the terms and conditions stated above as full and final settlement of any and all
claims arising out of or related to the subject of this Change Order and acknowledges that the
compensation (time and cost) set forth herein comprises the total compensation due for the work or
change defined in the Change Order, including all impact on any unchanged work. By signing this
Change Order, the Contractor acknowledges and agrees that the stipulated compensation includes
payment for all Work contained in the Change Order, plus all payment for any acceleration or
interruption of schedules, extended overhead costs, delay, and all impact or cumulative impact on all
Work under this Contract. The signing of this Change Order acknowledges full mutual accord and
satisfaction for the change and that the stated time and/or cost constitute the total equitable
adjustment owed the Contractor as a result of the change. The Contractor hereby releases and
agrees to waive all rights, without exception or reservation of any kind whatsoever, to file any further
claim or request for equitable adjustment of any type, for any reasonably foreseeable cause that shall
arise out of, or as a result of, this Change Order and/or its impact on the remainder of the Work under
the Contract.

1 and cobbles. Therefore, the conduits need to be installed with an open trench.
