A "MANDATORY" Pre -Bid Conference is scheduled for March 1, 2016 at 10:00 A.M. at the Project Site 31606 EI Camino Real, San Juan Capistrano to review the Project's existing conditions. Representatives of the City and consulting architects, will be present. Ques- tions asked by Bidders at the Pre -Bid Conference not specifically addressed within the Contract Documents shall be answered in writing, and shall be sent to all Bidders present at the Pre -Bid Conference. Bids will not be accepted from any bidder who did not attend the mandatory Pre -Bid Conference. The successful Bidder will be required to furnish a Faithful Performance Bond and a Labor and Material Payment Bond each in an amount equal to one hundred percent (100%) of the Contract Price. Each bond shall be in the forms set forth herein, shall be secured from a surety company that meets all State of California bonding requirements, as defined in Cali- fornia Code of Civil Procedure Section 995.120, and that is a California admitted surety in- surer. Pursuant to Section 22300 of the Public Contract Code of the State of California, the suc- cessful Bidder may substitute certain securities for funds withheld by City to ensure its per- formance under the contract. The Proect will be financed in Part by the following funding source in addgion to City funds: 8alifornia Department of Water Resources Proposition 84 funds Pursuant to Labor Code Section 1773, City has obtained the prevailing rate of per diem wages and the prevailing wage rate for holiday and overtime work applicable in Orange County from the Director of the Department of Industrial Relations for each craft, classifica- tion, or type of worker needed to execute this contract. A copy of these prevailing wage rates may be obtained via the internet at: www.chr.ca.gov, dfsr,' --- ui addition, a copy of the prevailing rate of per diem wages is available at the City Clerk Of- fice and shall be made available to interested parties upon request. The successful bidder shall post a copy of the Prevailing wage rates at each job site. It shall be mandatory upon the Bidder to whom the Contract is awarded, and upon any subcontractors, to comply with all Labor Code provisions, which include but are not limited to the payment of not less than the said specified prevailing wage rates to all workers employed by them in the execution of the Contract, employment of apprentices, hours of labor and debarment of contractors and subcontractors. Additionally Bidders are hereby notified that because the Project will be funded in part with Proposition 84 funds. a Labor Compliance Program ("LCP") will be implemented. City will initiate and enforce a LCP approved by the California Department of Industrial Relations. Under the LCP, City or its representative is required to monitor, audit, and investigate the practices of Contractor, and any subcontractor on the Project, concerning payment of pre- vailing wage, maintenance of proper payroll records, and observation of apprenti ct Dceship re- quirements under the Labor Code, as further described in these Contraocuments. The LCP will be enforced as required by state law and regulations and the Director of the De- partment of Industrial Relations. The following notice is given as required by Labor Code Section 1771.5(6)(1): Contractor and any subcontractors are required to review and comply with the provisions of the Cali- fornia Labor Code, Part 7, Chapter 1, beginning with Section 1720, as more fully discussed in the Contract Documents. These sections contain specific requirements concerning, for example, determination and payment of prevailing wages, retention, inspection, and audit- ing payroll records, limitations on use of volunteer labor, labor compliance programs, use of apprentices, payment of overtime compensation, securing workers' compensation insur- ance, and various criminal penalties or fines which may be imposed for violations of the re- quirements of the chapter. Pursuant to Labor Code sections 1725.5 and 1771.1, all contractors and subcontractors that wish to bid on, be listed in a bid proposal, or enter into a contract to perform public work must be registered with the Department of Industrial Relations. No Bid will be accepted for any contract entered into without proof of the contractor's and subcontractors' current 'egistration with the Department of Industrial Relations to perform public work. If awarded a contract, the Bidder and Its subcontractors, of any tier, shall maintain active registration Nith the Department of Industrial Relations for the duration of the Project. Jnless otherwise provided in the Instructions for Bidders. each Bidder shall be a licensed :ontractor pursuant to sections 7000 et seq. of the Business and Professions Code in the 'allowing classification(s) throughout the time it submits its Bid and for the duration of the :ontract: Class A or B. Substitution requests shall be made within 35 calendar days after the award of the con- ract. Pursuant to Public Contract Code Section 3400(b), the City may make findings des- gnating that certain additional materials, methods or services by specific brand or trade lame other than those listed in the Standard Specifications be used for the Project.
