Consideration of Award of a Contract for the Multi-modal Parking
Lot Pavement Rehabilitation Project (CIP 15301) and the La Sala
Parking Lot Pavement Rehabilitation Project (CIP 15303), and
Appropriation of Funds for the projects (Hillcrest Contracting, Inc.)
RECOMMENDATION:
By motion,
1. Award a Contract for the Multi-modal Parking Lot Pavement Rehabilitation
Project (CIP15301) and the La Sala Parking Lot Pavement Rehabilitation Project
(CIP 15303) to the lowest responsible bidder, Hillcrest Contracting, Inc., in the
amount of $296,206, with the condition that construction work will begin after
January 1, 2017; and
2. Authorize the City Manager to execute the contract and to approve change
orders up to 20% of the contract amount; and
3. Appropriate $22,700 from the Facilities Operations Internal Service Fund to
increase the budget for CIP 15303 from $51,725 to $74,425; and
4. Appropriate $24,216 from the Parking Maintenance Fund to increase the budget
for CIP 15301 from $308,700 to $332,916.

EXECUTIVE SUMMARY:
Bids were recently received for pavement rehabilitation of the Multi-modal and La Sala
Parking Lots, and staff is recommending award of a contract to the low bidder, Hillcrest
Contracting, Inc. Staff is also recommending a 20% contingency for the Multi-modal
Parking Lot rehabilitation project, rather than the normal 10%, due to the unknown
conditions of the base and sub-surface material that might necessitate excavations and
construction beyond the base contract amount. The total expected cost for the projects,
including contingencies and staff costs, is $401,316, which is $46,916 over the
remaining budget for the two projects. Staff is recommending appropriation of funds
from the Parking Maintenance Fund and Facilities Operations Internal Service Fund to
cover this shortfall.
The Project scope includes pavement rehabilitation and striping of the two parking lots,
installation of additional lighting, and construction of Americans with Disabilities Act
(ADA) compliant ramps for the Multi-modal Parking Lot. This work will also result in
three additional parking spaces in the Multi-modal Parking Lot. The locations of the two
parking lots are shown on Attachment 1 .
DISCUSSION/ ANALYSIS:
On September 28, 2016, staff met with a number of business owners to review the
schedule and scope of the project. The meeting attendees requested that the City
postpone the project's start date to January 2017 following the holiday season, and that
the City expedite the Multi-modal parking lot resurfacing to minimize the closure of this
lot as much as possible. Staff has discussed this requested project schedule with the
recommended contractor, Hillcrest Contracting, Inc., and a construction start date of
January 23, 2017, has been agreed upon. The contractor has committed to complete
the work in the Multi-modal parking lot within 1 0 calendar days, if he is allowed to work
nights and weekends, which staff intends to allow in order to expedite construction. The
resurfacing of the La Sala parking lot will be done after completion of the Multi-modal
parking lot.
The parking lots will be intermittently closed during the construction activities. Staff will
continue its robust outreach effort to notify those who might be impacted by the
closures. Notices will be sent to business owners, the Chamber of Commerce, and
residents in the Los Rios District. Signs will be posted in the Multi-modal lot a week in
advance of the work to notify commuters who park there while riding the train.
The Multi-modal Parking Lot is comprised of seven parcels, two of which are owned by
the City and five of which are owned by three private property owners. The City
maintains the Lot under agreements with the three other property owners. The
proposed scope of the work and the schedule of the work will be coordinated with those
property owners.

Three bids were received for this project as summarized below. The lowest responsive
bid was $296,206 by Hillcrest Contracting, Inc. Staff has checked the references for
Hillcrest Contracting, Inc., and has received positive feedback for Hillcrest's
performance. Hillcrest is properly licensed and is qualified to perform the work. Staff
recommends award of a contract to Hillcrest for the projects. Following is a summary of

Both projects require appropriations to cover budget shortfalls. The La Sala Parking Lot
Project has a shortfall of $22,700, and the Multi-modal Parking Lot Project has a
shortfall of $24,216. The Facilities Operations Fund and the Parking Maintenance Fund
have sufficient funding to cover these additional costs as a result of Fiscal Year 2015-16
projects that were completed substantially under budget. It is recommended that the
needed funds for the La Sala Project be appropriated from the Facilities Operations
Fund, and that the needed funds for the Multi-modal Project be appropriated from the
Parking Maintenance Fund. Following is a summary of the expected costs for the two
projects, the available budget, and additional funding needs.

ENVIRONMENTAL IMPACT:
This project has been reviewed in accordance with the provisions of the California
Environmental Quality Act (CEQA). The City's Environmental Administrator has
determined that the project is Categorically Exempt under CEQA Guidelines Section
15301, Class 1 (c) "Existing Facilities". The project is consistent with Section 15301 (c)
because the pavement rehabilitation and construction of American with Disabilities
compliant ramps project is in an area in which the public right of way exists with no
expansion.

Penco Engineering to perform professional engineering services to prepare

HILLCREST CONTRACTING, INC., sometimes hereinafter called "Contractor."
WITNESSETH: That the parties hereto have mutually covenanted and agreed, and by these
presents do covenant and agree with each other as follows:
a. SCOPE OF WORK. The Contractor shall perform all Work within the time stipulated in
the Contract, and shall provide all labor, materials, equipment, tools, utility services, and
transportation to complete all of the Work required in strict compliance with the Contract
Documents as specified in Article 5, below, for the following Project:

The Contractor and its surety shall be liable to the City for any damages arising as a result of
the Contractor's failure to comply with this obligation.
a. TIME FOR COMPLETION. Time is of the essence in the performance of the Work. The
Work shall be commenced on the date stated in the District's Notice to Proceed. The Contractor
shall complete all Work required by the Contract Documents within 20 working days from the
commencement date stated in the Notice to Proceed. By its signature hereunder, Contractor
agrees the time for completion set forth above is adequate and reasonable to complete the
Work.
b. CONTRACT PRICE. The City shall pay to the Contractor as full compensation for the
performance of the Contract, subject to any additions or deductions as provided in the Contract
Documents, and including all applicable taxes and costs , the sum of Two hundred Ninety Six
thousand Two hundred Six Dollars ($296,206). Payment shall be made as set forth in the
General Conditions.
c. LIQUIDATED DAMAGES. In accordance with Government Code section 53069.85, it is
agreed that the Contractor will pay the City the sum set forth in Section 00 73 13, Article 1.10
for each and every calendar day of delay beyond the time prescribed in the Contract Documents
for finishing the Work, as Liquidated Damages and not as a penalty or forfeiture. In the event
this Is not paid, the Contractor agrees the City may deduct that amount from any money due or
that may become due the Contractor under the Contract. This Article does not exclude recovery
of other damages specified in the Contract Documents.

applicable to this Work.
f. INDEMNIFICATION. Contractor shall provide indemnification and defense as set forth

g. PREVAILING WAGES. Contractor shall be required to pay the prevailing rate of wages
in accordance with the Labor Code which such rates shall be made available at the City's
Administrative Office or may be obtained online at http:/fwww.dir.ca.gov and which must be
posted at the job site.

The costs for any Work shown or required in the Contract Documents , but not specifically
identified as a line item are to be included in the related line items and no additional
compensation shall be due to Contractor for the performance of the Work .
In case of discrepancy between the Unit Price and the Item Cost set forth for a unit basis item ,
the unit price shall prevail and shall be utilized as the basis for determining the lowest
responsive , responsible Bidder. However, if the amount set forth as a unit price is ambiguous ,
unintelligible or uncertain for any cause , or is omitted , or is the same amount as the entry in the

The successful bidder hereby agrees to sign the contract and fum ish the necessary bonds and

bidder with the Notice of Award.
Upon receipt of the signed contract. and other required documents. the contract will be executed

Please note the following :
PCC pavement to be constructed as follows :
• Remove existing AC and AB materials to a depth necessary to accommodate the new
AB and PCC sections
• Stockpile ex isting AB materials for reuse, careful not to contaminate with subgrade
materials . The existing aggregate base should be tested to verify it meets gradation and
R-value requirements and for corrosion for compatibility with concrete if to be reused .
• Process the exposed subgrade to a depth of 6 inches , moisture condition to near
optimum moisture content , and re-compact to at least 90 percent
• Construct 4-inches thick (minim um) aggregate base layer, moisture conditioned to at
least optimum and compacted to at least 95 percent. Existing aggregate base may be
reused provided it is not contaminated with the subgrade soil or use new aggregate
base (CAB or CMB)
• Construct 7 -inch thick PCC pavement using 520-A-2500 PCC Mix
• Rebars will not be required . Construct weakened plane joints at 12 foot spacing or
less in both transverse and longitudinal directions (position the longitudinal joint away
from the wheel paths if possible) within 10 to 24 hours after PCC pour
