A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN JUAN CAPISTRANO, CALIFORNIA, PROVIDING FOR THE
ANNUAL SELECTION OF THE MAYOR AND MAYOR PRO TEMPORE
AND RESCINDING RESOLUTION NO. 93-09-21-06
WHEREAS, the offices of Mayor and Mayor pro tempore require a heavy
commitment of time by City Council Members who occupy either office; and
WHEREAS, it is desire of the City Council to establish a procedure which will
maximize the opportunity for the members of the City Council to share more equally in
the burdens and responsibilities of the offices of Mayor and Mayor pro tempore; and
WHEREAS, the City Council believes that its obligations can be best
accomplished by providing that the Mayor and Mayor pro tempore shall be selected on
an annual basis by the City Council; and,
WHEREAS, in election years, Resolution No. 93-09-21-06 requires that the
City Council select a Mayor and Mayor pro tempore no later than the fourth (4th)
Tuesday after each general municipal election (typically the first (1st) City Council
meeting in December); and
WHEREAS, recent changes in Elections law (Eiec. Code 15372(a)) now provide
counties up to 30 days to complete the official canvass of election results instead of the
original 28 days, thereby making it difficult to receive the official results by the fourth
(4th) Tuesday after the general municipal election; and
WHEREAS, the City Council believes it is most appropriate that the selection of
the Mayor and Mayor pro tempore not be made until the official results of the
City Council election are announced and Council members sworn in for new terms; and
WHEREAS, this can be accomplished by extending the selection deadline by two
weeks-from the fourth to the sixth Tuesday after each general municipal election.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
San Juan Capistrano as follows:
Section 1. The City Council shall select one of its members as Mayor and one
of its members as Mayor pro tempore no later than the sixth Tuesday after each general
municipal election. In years in which there is no general municipal election, the
selection shall take place at the first Council meeting in December, or as soon thereafter
as practicable.
Section 2. If a Mayor or Mayor pro tempore resigns or dies during the term of
office, the City Council shall select a new Mayor and/or Mayor pro tempore at the next
regular meeting following such death or resignation .
Section 3. City Council Resolution No. 93-09-21-06 is hereby rescinded.
