CCP412 Trail dedicationsCITY OF SAN JUAN CAPISTRANO COUNCIL POLICY Subject: Effective Policy Page Date Number DEDICATION AND IMPROVEMENT OF EQUESTRIAN/HIKING TRAILS 1 of 2 6/5/84 412 It is a policy of the City Council that all General Plan trails be dedicated and improved as public use easements. Said easements to be available for prescribed use and access for the general public. It is a policy of the City Council that all equestrian/hiking trails shall be designed and improved in accordance with the Equestrian/Hiking Trail Design Manual. It is a policy of the City Council that all landscape irrigation plans be designed such that sprinkler will not water trail easements. It is a policy of the City Council that the following standard conditions shall be applied to all subdivisions having equestrian feeder trails. 1. The developer shall improve and convey all equestrian feeder trails to the homeowners' association as a public use easement for all lots within the subdivision. 2. The homeowners' association shall irrevocably dedicate such easements to the City and shall execute and record, in the office of the County Recorder of the County of Orange, and agreement binding the Association, its successors and assigns to keep and maintain such equestrian feeder trails. 3. The following provisions shall be included within the CC&Rs for the subdivision: a. Provision for maintenance of all equestrian feeder trails by the homeowners' association. b. Provision requiring prior City approval of any amendment to the CC&Rs that will in any manner affect the integrity of the equestrian trail design standards, the equestrian feeder trail system or its level of maintenance. c. Provision requiring that all trail maintenance conforms to the "Maintenance Standards" as per the City's adopted "Equestrian/Hiking Trail Design Manual." Provision within the CC&Rs that gives the City the right to assume maintenance of the equestrian feeder trails if the City determines that the homeowners' association has not maintained the equestrian trail at the minimum standards per the adopted Equestrian/Hiking Trail Design Manual. Furthermore, if the City assumes maintenance of the trail system, all costs, including administration, shall become a lien on each property or residential lot within the subdivision. 4. If no homeowners' association is formed as a part of a subdivision, the developer shall record deed restrictions on each lot such that the individual property owner shall be responsible for maintenance of that portion of the equestrian trail easement traversing said lot. Said restrictions shall include a clause that "...if the individual property owner does not maintain the trail per the minimum standards of the adopted right to assume maintenance of the trail system. If the City assumes maintenance of the trail system. If costs, including administration, shall become a lien on the property." Furthermore, reciprocal easements shall be granted to each and every lot owner for use of said equestrian trail easement(s). 5. All equestrian feeder trails shall be designed and improved in accordance with the adopted Equestrian/Hiking Trail Design Manual. Said design and improvements to be included as a part of the grading plan, which is to be reviewed and approved by the City prior to recordation of a final map. All trail improvements to be installed and certified by the City as to conformance with approved plans prior to release of any use and occupancy permit. ###
