CCP009 Land LeaseCITY OF SAN JUAN CAPISTRANO COUNCIL POLICY Subject: Effective Policy Page Date Number LEASE OF PUBLIC LAND 1 of 1 4/1/86 009 It is a policy of the City Council that all requests for lease of public lands shall be submitted to the City Manager's Office for analysis and review. This policy will pertain to lease of vacant land only. Requests will be evaluated in the following areas to determine appropriateness prior to release for processing through normal City channels. 1. Public Benefit The proposed use shall be evaluated not only in terms of benefit to the public, but also absence of public detriment. Such factors as noise and traffic generation, aesthetics, environmental impacts, and neighborhood compatibility will be weighed in determining the appropriateness of the use. 2. Appropriateness of Use Appropriateness of use will be determined by such factors as the term of the proposed use, the possibilities for revenue generation, ability to meet a public need, and potential benefit to the land. 3. Proponent Credibility When requesting a lease of public land, the applicant shall be evaluated on the basis of his/her ability to accomplish what is proposed. Factors which will be considered include ability to meet insurance requirements, experience in a similar or related business, financial capability, and qualifications of key staff (if applicable). 4. Lease Requirements Applicant shall be able to meet minimum lease requirements including, but not limited to length of lease, special conditions (if applicable), required monthly payment based on comparable charges for similar uses (dependent on circumstances), ability to maintain the property, and a mutually agreed upon termination clause. Applicant must also agree to remove any improvements in the event of default or upon termination of the lease. If, after review of analysis, the City Manager's Office deems the proposed lease of public land as unobjectionable, the request will be submitted to the City Council for review. If conceptual approval is given by the Council, the applicant will be allowed to begin the normal City processes for project approval. ###
