SUBJECT: Consideration of Amendment No. 1 to Subdivision Improvement
Agreement (Final Tract 17441) (Development Solutions OAK, LLC) (The
Oaks)
RECOMMENDATION:
By motion, approve the Amendment No. 1 to Subdivision Improvement Agreement with
Development Solutions OAK, LLC, for Final Tract 17441.
SITUATION:
The originally posted agenda report inadvertently did not include the November 16,
2015, Trails and Equestrian Commission action.
COMMISSION/COMMITTEE/BOARD REVIEW AND RECOMMENDATIONS:
• At its November 16, 2015, Trails and Equestrian Commission meeting the
Commission took two (2) actions:
1^* Commission action, the Commission voted on a 3-1-1 vote, with
Commissioners Hanna, Zukow, and Vice-Chair Ritchie in favor. Chair Byrnes
against, and Commissioner Friess recused, to rescind their November 5, 2015,
recommendation to the City Council of construction of the San Juan Creek Trail
Extension with the Class I Bikeway being aligned adjacent to the Oaks
development, elimination of the mulch buffer, grading of the multi-use/equestrian
trail kept to a minimum and installation of a bio-swale on the outer edge of the
trail, closest to the creek.
2"^^ Commission action, the Commission voted on a 3-1-1 vote, with
Commissioners Hanna, Zukow, and Vice-Chair Ritchie in favor. Chair Byrnes
against, and Commissioner Friess recused, to recommend to the City Council to
leave the berm as is, with no improvements, including no Class I Bikeway, no
Multi-use trail and no bio-swale.
