SUBJECT: Consideration of a Class I Bikeway for the San Juan Creek Trail Extension
(The Oaks)
RECOMMENDATION:
By motion, approve construction of the San Juan Creek Trail Extension, with an asphalt
Class I Bikeway being aligned adjacent to the Oaks Development, a Multi-use trail being
installed nearest the creek, and installation of a bio-swale on the outer edge of the trail.
SITUATION:
At their November 5, 2015, Trails and Equestrian Commission (TEC) meeting the
Commission approved, on a 3-1 vote with one abstention, to recommend to the City
Council the construction of the San Juan Creek Trail Extension with the Class I Bikeway
being aligned adjacent to the Oaks development, elimination of the mulch buffer,
grading of the multi-use/equestrian trail kept to a minimum and installation of a bio-
swale on the outer edge of the trail, closest to the creek
Subsequently, at their November 16, 2015, Special Meeting the Equestrian and Trails
Commission voted 3-1-1, with Commissioners Hanna, Zukow, and Vice-chair Ritchie in
favor, Chair Byrnes against, and Commissioner Friess recused, to rescind their
November 5, 2015, recommendation to the City Council.
A new motion was made and voted on a 3-1-1, with Commissioners Hanna, Zukow, and
Vice-chair Ritchie in favor, Chair Byrnes against, and Commission Friess recused, to
recommend to City Council to leave the berm as is, with no improvements, including no
Class I Bikeway, no Multi-use Trail and no bio-swale.
The Planning and Zoning Law prohibits the adding of conditions of approval to approved
residential final maps for a period of five years. (Gov. Code 65961).

Staff recommends construction of the San Juan Creek Trail Extension, with an asphalt
Class I Bikeway being aligned adjacent to the Oaks Development, a Multi-use trail being
installed nearest the creek, and installation of a bio-swale on the outer edge of the trail.
This meets the requirements of Condition 1.22 of City Council Resolution 14-02-18-03,
which approved Tentative Tract Map 17441. It also presents a compromise by the
developer as was offered at the March 17, 2015 City Council Meeting.
