RECOMMENDATION :

EXECUTIVE SUMMARY:
The City has established various landscape maintenance districts which provide
landscape maintenance services within the following developments: Tract 7673-
Mission Woods, Tract 8485-Mission Springs, Tract 9284-Seaview Estates, Tracts
9373/7654-Los Corrales, Tract 9382-Belford Terrace, and Tract 11 094/Lot 29 of 11095-
Capistrano Royale ("Districts") (Attachment 1 ). On May 19, 2015, the City Council
adopted Resolution No. 15-05-19-01 (Attachment 5), which initiated proceedings and
declared intention to provide for an annual levy and collection of assessments for
maintenance services in the Districts.
As of July 1, 2015, it is projected the Districts will be at or above the target reserve level
(50% of projected assessments). For all but the Los Corrales district, no increase in
assessments is proposed for Fiscal Year 2015/2016. Property owners in the Los
Corrales district will be assessed an increase of 1.4% (tied to the Consumer Price
Index-All Urban Consumers for the Los Angeles, Riverside and Orange County Areas)
as their reserve level is projected to fall under the 50% reserve target level as of June
30, 2016. While this district's annual expenses typically average less than average
annual assessments, it is projected that their reserve balance will fall below the
projected target reserve level due to a scheduled maintenance project for its monument
sign.
In the upcoming year, staff will consider the implementation of an asset replacement
study (discussed below) to identify assets and replacement cost values to better
determine appropriate reserve levels for each district. The cost of this proposed asset
replacement study will be considered for inclusion in the Fiscal Year 2016/2017
proposed budget if required. Once performed, the study findings will be taken to City
Council for further direction. Based on the direction received, a Proposition 218
proceeding to adjust assessments may be required.
Staff recommends adopting the Resolution (Attachment 2) confirming the assessments
for the six (6) districts, and authorizing the Orange County Auditor Controller's Office to
include the assessments on the Property Tax Roll (Exhibit A). Exhibit B of the
Resolution will formalize the City's request to place a special assessment on tax bills,
being charged a fee for this service, providing indemnification, and other provisions.

DISCUSSION/ANALYSIS:
Routine landscape maintenance is performed at each of the Districts and includes
mowing, weeding, fertilization, tree trimming, and de-thatching and aerating of turf
areas. In addition, dead plant material replacements and irrigation repairs are
performed as necessary.
The maintenance of the six Districts is contracted to a number of maintenance
companies and billed directly to the City. The maintenance costs are reimbursed to the
City through the above mentioned annual assessments. In addition to the maintenance
costs, staff time required to oversee the contractors who perform work in the district and
administrative overhead charges are charged to each district. At any time throughout
the year, residents are able to contact staff with requests and inquiries related to their
landscape maintenance district. Additionally, at least one public workshop is held
annually to solicit resident input. This year, the public workshop was held on
Wednesday, March 19, 2015. The public workshop affords the residents of each district
an opportunity to address items of concern that are beyond that of routine maintenance
and repair that they would like to bring to the attention of the City. Staff received
comments from two (2) residents of Belford Terrace regarding hillside and sod
conditions, as well as maintenance frequency of those areas. A resident from Los
Corrales expressed his concerns regarding the selection of the landscape maintenance
contractor that will begin in July 2015, as well as reserve level issues. The residents
were informed that the new landscape maintenance contract will include specifications
regarding the frequency of maintenance and the minimum maintenance requirements.
The asseUreplacement inventory was also discussed to help identify appropriate capital
reserve levels. All concerns were noted and addressed.
Drought response actions --Due to the drought, staff has implemented the two (2) day
per week watering restrictions in the landscape maintenance districts. Additionally, staff
will evaluate each district to identify projects that could be implemented to facilitate
water conservation. In the coming months, staff will request input from the residents
regarding ideas for future turf replacement projects or other water saving actions.
Resident ideas along with recommendations from Marina Landscape Maintenance, Inc.
(the City's new landscape maintenance contractor effective July 1, 2015) for projects
such as turf removal and replacement with native plantings, water audits, and the use of
specialized irrigation systems will be considered. The scope and future costs of
potential projects will be brought to the homeowners for their approval. Final
recommendations and financial considerations as they pertain to each district will then
be presented to City Council for approval at that time.
Based on future water conservation projects that will be implemented in each district,
staff anticipates savings in the areas of water costs as well as modifications to the
contract cost for landscape maintenance. If it becomes necessary to increase the
assessment in any district to pay for the water conservation projects, a Proposition 218
process will be required with the new assessments being effective on the following

year's property tax bill. Future water conservation project costs will be offset with water
cost and landscape maintenance savings and will be paid for with district reserve
funding.
FISCAL IMPACT:
The Engineer's Report (Attachment 3), which is prepared by staff, provides detailed
budget information for each district. The table below reflects the proposed budgets for
Fiscal Year 2015/2016, as well as the proposed assessments for each district.

Annual expenditures are comprised of the following: Utility costs, maintenance contracts
costs, capital improvement projects, salary, overhead, administrative costs, and any
extras (miscellaneous work) for each district. The total costs to operate and maintain
the districts are assessed annually to the property owners through property taxes.
Note that the proposed expenditure budgets for the Mission Woods, Seaview Estates,
Belford Terrace and Capistrano Royale districts are slightly higher than the anticipated
assessment collection for the upcoming year. The projected expenditures will not draw
their reserve below the target 50% reserve level. The proposed budget of the Los
Corrales district is also higher than the projected assessments, however, the average
annual expenditures (based on last three years) have not exceeded the assessments
collected. Staff will continue to regularly monitor and evaluate expenditures throughout
the year for all of the districts in an effort to reduce expenses and maintain the target
reserve levels.
ENVIRONMENTAL IMPACT:
In accordance with California Environmental Quality Act (CEQA) standards, the
maintenance performed within the landscape maintenance districts is exempt from the
CEQA pursuant to CEQA Guidelines Section 15301 (h) and 15061 (8)(3).

Public Hearing date and time (Attachment 4). Staff will forward the assessment data to
the Orange County Auditor-Controller to include the assessments on the Property Tax
Roll upon City Council adoption of the Resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, CONFIRMING THE LEVY OF THE FISCAL
YEAR 2015/2016 ASSESSMENTS FOR THE LANDSCAPE MAINTENANCE
DISTRICTS IN THE CITY OF SAN JUAN CAPISTRANO AND AGREEMENT
FOR COLLECTION OF SPECIAL TAXES, FEES, CHARGES AND
ASSESSMENTS WITH THE COUNTY OF ORANGE
WHEREAS, the CITY COUNCIL of the CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, did on the 16th day of June 2015, adopt Resolution No. 15-06-16-XX
declaring its intention to levy assessments for Fiscal Year 2015/2016 and approving the
Engineer's Report for the City of San Juan Capistrano Landscape Maintenance Districts;
and,
WHEREAS, following notice duly given in accordance with law, the CITY COUNCIL
of the CITY OF SAN JUAN CAPISTRANO has held a full and fair public hearing regarding
the levy and collection of the proposed assessments within the Landscape Maintenance
Districts for Fiscal Year 2015/2016 to pay for the costs and expenses of the improvements
described in the Engineer's Report for the San Juan Capistrano Landscape Maintenance
Districts; and,
NOW, THEREFORE, BE IT RESOLVED, that the CITY COUNCIL of the
CITY OF SAN JUAN CAPISTRANO
1) Confirms the assessments set forth in Exhibit "A" for the San Juan
Capistrano Landscape Maintenance Districts as filed, and authorizes
the assessments to be sent to the County of Orange Auditor-
Controller for collection at the same time and in the same manner as
the County taxes are collected.
2) Authorizes the Agreement set forth in Exhibit "B" with the County of
Orange for Collection of Special Taxes, Fees, Charges, and
Assessments.

AGREEMENT FOR COLLECTION OF SPECIAL
TAXES, FEES, CHARGES AND ASSESSMENTS
THIS AGREEMENT is made and entered into this __ day of , 2015 by and
between the COUNTY OF ORANGE, a political subdivision of the State of California, hereinatier
referred to as ''County'' and City of San Juan Capistrano , hereinafter
referred to as 'District".
RECITALS
The following recitals arc a substantive part ofthis Agreement:
WHEREAS, the parties desire to enter into an agreement whereby taxes and special
assessments for the District will be collected by the County at the same time and in the same
manner as County taxes arc collected and the District will pay to the County the fees for
collection hereinaticr set forth; and
WHEREAS, Section 29142 ofthe Government Code provides that when taxes or
assessments are collected by a county for any special district, or zone, or improvement district
thereof, excluding a school district, the board of supervisors may provide for a collection tee tor
such services; and
WHEREAS, Section 29304 of the Government Code provides that whenever any special
assessment or special assessment taxes are levied upon land or real property by any city, county,
district or other public corporation, and the same are to be collected by a County, there shall be
added to the amount of the special assessment or special assessment tax an amount fixed by
agreement between the county and city, district, public corporation, officer, or body tor each
special assessment or special assessment tax to be collected; and
WHEREAS, Section 51800 of the Government Code provides for the County to collect
special assessments on County property tax rolls for cities and districts located in the County, and to
enter into an agreement regarding the amount of compensation to be paid to the County for the
collection of such assessments; and
WHEREAS, when requested by District, it is in the public interest that the County collect on
the County tax rolls the special taxes, fees, and assessments for District.
NOW, THEREFORE, IT IS AGREED by and between the parties hereto as follows:
AGREEMENT
I. Collection Services. County agrees, when requested by District as hereinafter
provided, or as required by law, to collect on the County tax rolls the special taxes, tees, and
assessments of District, and of each zone or improvement District thereof.
2. Transmission of Information. When County is to collect District's special taxes and
assessments, District agrees to notify the Orange County Auditor-Controller of the Assessor's parcel

numbers and the amount of each special tax. fee, or assessment to County, and including, but not
limited to, any act of omission or assessment to be so collected.
3. Certification by the District. The District shall certify to the Orange County
Auditor-Controller the fixed charge special assessments in a dollar amount to be applied on each
parcel of real property which parcel shall be designated by the assessment (i.e., parcel) number
shown on the County Secured Assessment Roll for the year in which the assessment is to be
collected ..
4. Verification by District. It shall be the obligation of the District prior to the time of
delivery to the Orange County Auditor-Controller of the fixed charge special assessment roll to
check the County Secured Assessment Roll after it is filed by the Orange County Assessor with the
Orange County Auditor-Controller to verify that the parcel numbers on the assessment roll for fixed
charge special assessments certified by the District correspond with the assessment (i.e., parcel)
numbers shown on the County Secured Assessment Roll. Any changes in special assessment data
previously certilied to the Orange County Auditor-Controller by the District, which changes occur as
a result of such verification, shall be certified by the District to the Orange County Auditor-
Controller .
5. Collection Fee. County will charge the sum of 0.30 percent (0.30%) of the original
value for each special tax, fee, or assessment that is to be collected on the County tax rolls by the
County for the District.
6. Charge for Revision of Assessment. After the roll has been delivered by the Orange
County Auditor-Controller to the Orange County Tax Collector the County will charge the District
for each fixed charge special assessment changed or deleted. Said charge shall be $15.00 for each
assessment or parcel number placed on the County Secured Assessment Roll. Payment shall be
submitted to the Orange County Auditor-Controller with the request for the change or deletion.
7. Modification of Collection Fees and Charges. The County reserves the right to
increase or decrease any charges herein provided in proportion to any changes in costs incurred by
the County in providing the services described herein, provided that written notice of any increase or
decrease in charges shall be given by the County to the District on or before May 15 of any year
during the term of the Agreement.
8. Authority for Levy and Compliance with Law. District warrants that the taxes, fees,
or assessments imposed by District and collected pursuant to this Agreement comply with all
requirements of state law, including but not limited to Article XIIIC and XlllD of the California
Constitution (Proposition 218).
9. Release. District hereby releases and forever discharges County and its officers,
agents and employees from any and all claims, demands, liabilities, costs and expenses, damages,
causes of action, and judgments, in any manner arising out of District's responsibility under this
agreement, or other action taken by District in establishing a special tax. fee, or assessment and
implementing collection of special taxes or assessments as contemplated in this agreement, including
but not limited, any required remedial action in the case of delinquencies in such assessment
payments or the issuance, sale, or administration of any bonds issued in connection with the
District's program.

10. Indemnification. District agrees to and shall defend, indemnify and save ha1111less
County and its officers, agents and employees ('"indemnified parties") trom any and all claims,
demands, liabilities, costs and expenses. damages, causes of action, and judgments, in any manner
arising out of any of District's responsibility under this agreement, or other action taken by District in
establishing a special tax, fee, or assessment and implementing collection of special taxes, fees, or
assessment as contemplated in this agreement, including but not limited, any required remedial action
in the case of delinquencies in such assessment payments or the issuance, sale, or administration of
any bonds issued in connection with the District's program.
II. Cooperation. District agrees that its officers, agents and employees will cooperate
with County by answering inquiries made to District by any person concerning District's special tax,
fee, or assessment, and District agrees that its officers, agents and employees will not refer such
individuals making inquiries to County officers or employees for response.
12. Assignment. District shall not assign or transfer this agreement or any interest herein
and any such assignment or transfer or attempted assignment or transfer of this agreement or any
interest herein by District shall be void and shall immediately and automatically terminate this
agreement.
13. Term of Agreement. All existing agreements between the County and District
pertaining to collection of taxes and special assessments by the County for the District shall be
terminated upon the execution of this Agreement. This Agreement shall continue from year to year
and shall be subject to cancellation by either party by giving written notice to the other party of
cancellation prior to July I st of the preceding tis cal year.
14. Waiver. County or District's waiver of breach of any one term, covenant, or other
provision of this agreement, is not a waiver of breach of any other term, nor subsequent breach of' the
term or provision waived.

DEFINITION & GENERAL INFORMATION
Assessment District
An Assessment District is a financing mechanism under The California Streets and Highways
Code, Division 10 and 12, which enables cities, counties, and special districts organized for the
purpose of aiding in the development or improvement to, or within the district, to designate
specific areas as Assessment Districts, with the approval of a majority of the landowners based
on financial obligations, and allows these Districts to collect funds to finance maintenance
efforts or construct improvements. Assessment Districts help each property owner pay a fair
share of the costs of such improvements or maintenance obligations over a period of years at
reasonable rates and insures that the cost will be spread to all properties that receive direct and
special benefit by the improvements constructed or maintained.
"Assessment" means any levy or charge by an agency upon real property that is based upon
the special benefit conferred upon the real property by a public improvement or service that is
imposed to pay the capital cost of the public improvement, the maintenance and operation
expenses of the public improvement, or the cost of the service being provided. "Assessment"
includes, but is not limited to, "Special Assessment," "Benefit Assessment," and "Maintenance
Assessment."

Current Annual Administration
As required by the Landscaping and Lighting Act of 1972, this Engineer's Report describes the
improvements to be operated, maintained, and serviced by the District, provides an estimated
budget for the District, describes the properties and zones of benefit within the District,
describes the method used to allocate the costs to the benefiting properties within the District,
and lists the proposed assessments to be levied upon each assessable lot or parcel within the
District.
Payment of the assessment is placed on each property owner's secured property tax roll bill. All
funds collected through the assessment must be placed in a special fund and can only be used
for the purposes stated in this report.

duly appointed ENGINEER OF WORK, submit herewith the "Report" consisting of six (6) parts
as follows:
PART A: DESCRIPTION OF IMPROVEMENTS
Part A describes the improvements in the District. Plans and specifications for the
improvements showing and describing the general nature, location and extent of the
improvements are on file in the Office of the City Clerk of the City of San Juan Capistrano, and
are incorporated herein by reference.
PART B: ESTIMATE OF COST
Part 8 contains an estimate of the cost of the proposed improvements for Fiscal Year 2015-
2016, including incidental costs and expenses in connection therewith.
PART C: ASSESSMENT DISTRICT DIAGRAM
The Diagram of the Assessment Districts' Boundaries showing the exterior boundaries of the
Assessment Districts, the boundaries of any zones within the Assessment Districts and the lines
and dimensions of each lot or parcel of land within the Assessment Districts.
The lines and dimensions of each lot or parcel within the Assessment Districts are those lines
and dimensions shown on the maps of the Assessor of the County of Orange for the year when
this Report was prepared. The Assessor's maps and records are incorporated by reference
herein and made part of this Report.
PART D: METHOD OF APPORTIONMENT OF ASSESSMENTS
The method of apportionment of assessments, indicating the proposed assessment of the total
amount of the costs and expenses of the improvements upon the several lots and parcels of
land within the Assessment Districts, in proportion to the estimated benefits to be received by

fixtures and appurtenant facilities in public rights-of-way, parkways, slopes, and dedicated
easements within the boundaries of said Landscape Maintenance Districts.
The facilities are specifically described as follows:
Mission Woods Open Space Maintenance District (Tract 7673)
0. 828 acres of maintenance including:
Ortega Highway right-of-way, exclusive of the street section to the southerly curb, along the
northerly boundary of Tract 7673; and the area northerly of the curved walls at the intersection
of Ortega Highway and Via Cuartel, being a portion of Lot I and Lot 79.

The westerly two feet, lying northerly of Lot B, being a portion of Lots 71 and 72.

Maintenance means the furnishing of services and materials for the ordinary and usual
maintenance, operation and servicing of the landscaping and appurtenant facilities, including
repair, removal or replacement of all or part of any of the landscaping or appurtenant facilities;
providing for the life, growth, health and beauty of the landscaping, including cultivation,
irrigation, trimming, spraying, fertilizing and treating for disease or injury; the removal of
trimmings, rubbish, debris and other solid waste; and the cleaning, sandblasting and painting of
walls and other improvements to remove or cover graffiti.
Servicing means the furnishing of water for the irrigation of the landscaping and the
maintenance of any of the public lighting facilities or appurtenant facilities and the furnishing of
electric current or energy, gas or other illuminating agent for the public lighting facilities, or for
the lighting or operation of landscaping or appurtenant facilities.
The plans and specifications for the improvements, showing and describing the general nature,
location and the extent of the improvements, are on file in the office of the Director of Public
Works and are incorporated herein by reference.

PARTS
ESTIMATE OF COST
The 1972 Act provides that the total cost of installation, construction, operation, maintenance
and servicing of the improvements described in Part A can be recovered by the Districts.
Maintenance can include the repair and replacement of existing facilities. Servicing can include
electrical and associated costs from a public utility. Incidental expenses, including
administration of the Districts, engineering fees, legal fees, printing, posting and mailing of
notices, and all other costs associated with the annual assessment process can also be
included.
The estimated costs of the operation, servicing and maintenance of the improvements for Fiscal
Year 2015-2016, as described in Part A, are summarized herein and described in the Proposed
Budgets on the subsequent pages.
The 1972 Act requires that a special fund be set up for the revenues and expenditures of the
Districts. Funds raised by assessment shall be used only for the purpose as stated herein. A
contribution to the District by the City may be made to reduce assessments, as the City Council
deems appropriate. Any balance or deficit remaining on July 1 must be carried over to the next
fiscal year.

PART D
METHOD OF APPORTIONMENT OF ASSESSMENT
GENERAL
Part 2 of Division 15 of the Streets and Highways Code , the Landscaping and Lighting Act of
1972 , permits the establishment of assessment districts by public agencies for the purpose of
providing certain public improvements which include operation , maintenance and servicing of
street lights, traffic signals , and landscaping .
Section 22573 of the Landscape and Lighting Act of 1972 requires that ma intenance
assessments be levied according to benefit rather than according to assessed value . This
Section States :
"The net amount to be assessed upon lands within an assessment district may
be apportioned by any formula or method which fairly distributes the net amount
among all assessable lots or parcels in proportion to the estimated benefit to be
received by each such lot or parcel from the improvements ."
In addition , Article XIIID , Section 4(a) of the California Constitution limits the amount of any
assessment to the proportional special benefit conferred on the property .
The Act permits the designation of benefit zones with in any individual assessment district if "by
reasons or variations in the nature , location , and extent of the improvements , the various areas
will receive different degrees of benefit from the improvement" (Sec. 22574). Thus , the 1972
Act requires the levy of a true "benefit assessment" rather than a "special tax ." Excepted from
the assessment would be the areas of all publicly owned property in use in the performance of a
public function . Utility rights-of-way are also exempt from assessment.
ASSESSMENT METHODOLOGY
The total operation , maintenance and servicing costs for the landscape ma intenance district
improvements are apportioned in accordance with the benefit spread methodology described
below.
General Versus Special Benefit
The City may only assess property owners for that portion of the improvements which provide a
special and direct benefit to the properties located within the boundaries of the District. General
benefits are not assessable and the City must fund that portion of the improvements wh ich
provides a general benefit to the public at large with some other funding source such as the
general fund . The 1972 Act does not specify a formula or method to use when determining the
amount of general versus special benefit. The Engineer of Work is responsible for conducting
the general versus special benefit analysis and then making a recommendation to the City
Council , which makes the final determination .

assessment apportioned to each lot or parcel within the Districts, as shown on the latest roll at
the County of Orange Assessor's Office, are contained in the Assessment Rolls as shown in this
section. The description of each lot or parcel is part of the records of the Assessor of the
County of Orange and these records are, by reference, made part of this Report.
The included tracts of land have been subdivided into Single-Family Residential (SFR) lots, with
each of these lots benefiting equally from the improvements being maintained. Therefore, the
costs associated with the landscaping within and directly adjacent to each tract, as shown in
Part B of this report will be apportioned equally to the residential lots within each tract. The

FINANCIAL SUMMARY
OPERATING EXPENDITURES
The following information describes the types of costs associated with maintaining the Districts.
CPI-U-Annual Increase According to Need
Staff recommends that assessments are increased annually per the Consumer Price Index-All
Urban Consumers for the Los Angeles, Riverside and Orange County Areas (CPI-U) on an as
needed basis. Should the District reach a reserve level of 50% of operating revenues, the
assessment will not be increased per the CPI-U for the year. Each year, the City will evaluate
the reserves and the expenditures, and inform the residents whether or not an increase per the
CPI-U will be necessary for the upcoming year.
Contract and City Forces
Most of the work performed at the District is contracted out and includes landscape
maintenance, herbicide and pesticide, and tree trimming. The "City Forces" line item in the
proposed budget includes the City field staff time required to monitor the work that is being
performed per the contracts. Actual staffing costs and expenditures are charged to each
District. The City currently charges for administrative and management staff time associated
with administering the landscape maintenance districts.
Irrigation Repairs/Extras
The line item in the proposed budget and the financial study for "Irrigation Repairs/Extras"
includes any repairs that are not typically scheduled throughout the year such as irrigation
repairs, broken tree limbs, vandalism, etc. An estimate has been included to cover such
expenditures, and if the amount actually spent each year is less than the estimate, the
remaining balance returns to the District's reserve fund. Should the amount exceed the
estimate, then the funds needed would be taken from the reserve fund.
Maintenance Upgrades/Projects
The line item in the proposed budget and financial study for "Maintenance Upgrades/Projects"
includes any new projects such as painting, plantings, fencing repairs, etc. that can be
scheduled for the upcoming year. Often, City staff receives input from residents on any projects
that a District may like to see completed. The proposed budget includes an estimate for these
projects, and if the amount actually spent each year is less than the estimate, the remaining
balance returns to the District's reserve fund. Should the amount exceed the estimate, then the

Reserve Fund
Any remaining funds not used from the previous year are added to the District's reserve fund.
The reserve fund should have sufficient funds available to lessen the fiscal impact of any
unforeseen expenditures. At City Council direction, each District needs to maintain a healthy
reserve balance at 50% of the total annual assessments.

PLANS, SPECIFICATIONS, COST ESTIMATE, DIAGRAM, ASSESSMENT
AND REPORT PURSUANT TO THE PROVISIONS OF DIVISION 15, PART
2 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF
CALIFORNIA AND CHAPTER 2.5 OF DIVISION 1 OF TITLE 5 OF THE
GOVERNMENT CODE OF THE STATE OF CALIFORNIA, FOR
PROCEEDINGS FOR THE ANNUAL ASSESSMENT LEVY AFTER
FORMATION OF A DISTRICT, AND SETIING A TIME AND PLACE FOR

WHEREAS, the CITY COUNCIL of the CITY OF SAN JUAN CAPISTRANO,
CALIFORNIA, has previously formed six landscape maintenance districts pursuant to the
terms and provisions of the "Landscaping and Lighting Act of 1972," being Division 15, Part
2 of the Streets and Highways Code of the State of California, in what is known and
designated as follows: Mission Woods Landscape Maintenance District, Mission Springs
Landscape Maintenance District, Seaview Estates Landscape Maintenance District, Los
Corrales Landscape Maintenance District, Belford Terrace Landscape Maintenance
District, and Capistrano Royale Landscape Maintenance District (hereinafter referred to as
the "Districts"): and ,
WHEREAS, at this time, this City Council desires to take proceedings to provide for
the annual levy of assessments for the next ensuing fiscal year, to provide for the costs
and expenses necessary for continual maintenance of those improvements within said
Districts that are exempt pursuant to California Constitution Article XIIID ; and,
WHEREAS, at this time there has been presented and approved by this City
Council, the Preliminary Engineer's Report as required by law, and this City Council desires
to continue with the proceedings for said annual levy.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby resolves, determines and orders as follows:
SECTION 1 -PUBLIC INTEREST
The public interest and convenience requires, and it is the intention of this City
Council, to undertake proceedings for the annual levy and collection of special
assessments for the continual maintenance of certain improvements, all to serve
and benefit said Districts as said areas are shown and delineated on maps as
provided in the Engineers Report on file in the Office of the City Clerk, open to
public inspection, and therein so referenced and made a part hereof.

SECTION 2 -REPORT
The Preliminary Engineer's Report regarding the annual levy for said Districts, which 1
Report is for maintenance for the Fiscal Year 2015/2016, is hereby approved and is 1 ,
directed to be filed in the Office of the City Clerk. '
SECTION 3 -ASSESSMENT
That the public interest and convenience requires, and it is the intention of this City
Council to order the annual assessment levy for the Districts as set forth and
described in said Engineer's Report, and further it is determined to be in the best
public interest and convenience to levy and collect annual assessments to pay the
costs and expenses of said maintenance and improvement as estimated in said
Reports.
SECTION 4-DESCRIPTION OF MAINTENANCE
The assessment levied and collected shall be for the maintenance of certain
landscaping improvements, as set forth in the Engineer's Report, referenced and so
incorporated herein.
SECTION 5-COUNTY AUDITOR
The County Auditor shall enter on the County Assessment Roll the amount of the
assessments, and shall collect said assessments at the time and in the same
manner as County taxes are collected. After collection by the County, the net
amount of the assessments, after the deduction of any compensation due to the ......,
County for collection, shall be paid to the Treasurer for purposes of paying for the
costs and expenses of said District.
SECTION 6-SPECIAL FUND
All monies collected shall be deposited in a special fund known for each landscape
maintenance district. Payment shall be made out of said fund only for the purpose
provided for in this Resolution, and in order to expedite the making of this
maintenance and improvement, the City Council may transfer into said funds as it
may deem necessary to expedite the proceedings. Any funds shall be repaid out of
the proceeds of the assessments provided for in this Resolution.
SECTION 7-BOUNDARIES OF DISTRICTS
Said contemplated Districts have been determined previously, in the opinion of this
City Council, to be exempt from the provisions of California Constitution Article
XIIID, and the improvements have been determined to be of direct benefit to the
properties within the boundaries of the Districts, and this City Council makes the
costs and expenses of said maintenance chargeable upon those Districts, which
Districts said City Council hereby declares to be the Districts benefited by said
improvement and maintenance, and to be further assessed to pay the costs and
expenses thereof. Said Districts shall include each and every parcel of land within
the boundaries of said Districts, as said Districts are shown on the maps provided in
the Engineer's Report on file in the Office of the City Clerk, and so designated by n
the name of the Districts. .

SECTION 8-PUBLIC PROPERTY
Any lots or parcels of land known as public property, as the same are defined in
Section 22663 of Division 15, Part 2 of the Streets and Highways Code of the State
of California, which are included within the boundaries of the Districts, shall be
omitted and exempt from any assessment to be made under these proceedings to
cover any of the costs and expenses of said improvement and maintenance work.
SECTION 9-PUBLIC HEARING
Notice is hereby given that Tuesday, the 161hof June, 2015, at 5:00p.m., in the City
Council Chambers located at 32400 Paseo Adelanto, San Juan Capistrano, is the
time and place fixed by this City Council for the hearing of protests or objections in
reference to the annual levy of assessments, to the extent of the maintenance, and
any other matters contained in this resolution by those property owners affected
hereby. Any persons who wish to object to the proceedings for the annual levy
should file a written protest with the City Clerk prior to the time set and scheduled
for said public hearing.
SECTION 10-NOTICE
The City Clerk is hereby authorized and directed to publish, pursuant to
Government Code Section 6061, a notice of the Public Hearing in the Capistrano
Valley News, a newspaper of general circulation within said City, said initial
publication to be not less than ten (10) days before the date set for said Public
Hearing. Said notice shall include that information required pursuant to Government
Code Section 54954.6(2).
The City Clerk is further directed to cause a copy of the Resolution of Intention and
said notice to be posted upon the official bulletin board customarily used for the
posting of notices.
SECTION 11 -EFFECTIVE DATE
This Resolution shall take effect immediately upon its adoption.
