Resolution Number 16-05-03-03 RESOLUTION NO. 16-05-03-03 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO WAIVE THE FORMAL RFP/RFQ BID PROCESS AS A NON COST-EFFECTIVE APPROACH, AND AUTHORIZING STAFF TO PROCEED WITH AWARDING AN AGREEMENT FOR TREE MAINTENANCE SERVICES WHEREAS, the City has contracted with West Coast Arborists, Inc. for tree maintenance services since 2009; and WHEREAS, the contract with West Coast Arborists, Inc. expires on June 30, 2016; and WHEREAS, tree maintenance is a critical operational function to protect the health and safety of the public and preserve the health, beauty, and longevity of the trees in the City's urban forest; and WHEREAS, the City of Laguna Niguel recently bid and awarded a contract for tree maintenance services to West Coast Arborists, Inc.; and WHEREAS, the City desires to piggyback on the competitive procurement performed by the City of Laguna Niguel; and WHEREAS, Section 3-4.304 of the San Juan Capistrano Municipal Code provides that maintenance services contracts over $25,000 are subject to a formal RFP/RFQ bid process; and WHEREAS, Section 3-4.306(e)(3) of the San Juan Capistrano Municipal Code provides an exception to the formal RFP/RFQ process where the process is deemed not to be the most cost-effective approach; and WHEREAS, undergoing a formal RFP/RFQ process for tree maintenance services would not be the most cost-effective approach given the City's need to receive expedited tree maintenance services coupled with the ability to rely on a competitive procurement recently performed by a neighboring city at a highly competitive and reasonable price; and WHEREAS, West Coast Arborists, Inc., is one of the largest tree maintenance contractors in California and is sufficiently qualified and experience to perform the tree maintenance services required by the City and has indicated that it will provide the same pricing to the City as it provided to the City of Laguna Niguel for said services. 1 05-03-2016 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, HEREBY RESOLVES, FINDS AND DETERMINES AS FOLLOWS: 1. That the foregoing recitals are true and correct and incorporated herein by this reference. 2. That undergoing a formal RFP/RFQ process at this time for tree maintenance services would not be the most cost-effective approach. 3. That the City Manager or his designee is hereby authorized to enter into a contract with West Coast Arborists, Inc., on behalf of the City, for tree maintenance services, without undergoing the formal RFP/RFQ process.
