Resolution Number 16-04-19-01RESOLUTION NO. 16-04-19-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING DESIGNATED FLEET INVENTORY AS SURPLUS WHEREAS, the City owns and maintains a fleet of vehicles and equipment for the purpose of providing field services and transportation; and, WHEREAS, from time to time vehicles and equipment are retired when they reach the end of their useful lives and are prepared for sale to obtain their residual value; and, WHEREAS, the City has determined that the vehicles identified in Exhibit "A" ("Property") have reached the end of their useful lives and their condition is not worth the cost of repair and maintenance, and therefore the City plans to replace these vehicles; and, WHEREAS, the City has determined that the Property should be declared surplus when removed from service; and WHEREAS, Government Code sections 37350 and 37351 authorize the City to purchase, control, and dispose of personal property for the common benefit of the City; and WHEREAS, the City Council finds that the sale of the surplus Property for replacement is necessary to maintain the City's safe and usable fleet of vehicles for City services and transportation, and therefore is for the common benefit of the City. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby find and determine as follows: 1. The foregoing recitals are true and correct and incorporated herein by this reference. 2. The Property identified in Exhibit A, incorporated herein by this reference, has reached the end of its useful life and is deemed to be surplus for which replacements are to be purchased for the common benefit of the City. 3. The City Manager is authorized to declare said Property as "surplus" property pursuant to section 3-4.401 of the San Juan Capistrano Municipal Code within 180 days of receipt of new vehicles purchased and their placement into the service of the City. The City Council approves of the disposition of the Property in accordance with Municipal Code section 3-4.401 (e). Page 1 of 3 4/19/2016 4. Staff is directed to proceed with disposition of the Property in accordance with all City rules and regulations and Municipal Code section 3-4.401.
